Regulations of Federal Communications Agency on implementation of departmental control in the sphere of purchases for ensuring the state needs concerning the subordinated organizations

I. General provisions

1. These Regulations establish rules of implementation by Federal Communications Agency (further - Body of departmental control, the Agency) departmental control in the sphere of purchases of goods, works, services for ensuring the state needs of the subordinated organizations (further - Regulations).

2. The regulations are developed for the purpose of increase in efficiency of implementation of purchases, ensuring publicity and transparency of implementation of purchases, prevention of corruption and other abuses in the sphere of purchases.

3. Subject of departmental control in the sphere of purchases is observance by customers (including contractual services, contractual managing directors, the commissions and other officials), the subordinated organizations (further - subordinated customers, objects of departmental control) requirements of the legislation of the Russian Federation about contractual system in the sphere of purchases.

4. When implementing the departmental control Body of Departmental Control performs check of compliance with law of the Russian Federation about contractual system in the sphere of purchases, including:

4.1. Observance of the restrictions and prohibitions established by the legislation of the Russian Federation on contractual system in the sphere of purchases.

4.2. Observance of requirements to reasons and justification of purchases, the stipulated in Article 18 Federal Laws of 05.04.2013 No. 44-FZ "About contractual system in the sphere of goods, works, services for ensuring the state and municipal needs" (further - the Law 44-FZ).

4.3. Observance of requirements about regulation in the sphere of purchases, the stipulated in Article 19 Laws 44-FZ.

4.4. Correctness of determination and reasons for the starting (maximum) price of the contract, the price of the contract signed with the single supplier (the contractor, the contractor).

4.5. Compliance of information on amount of financial provision included in procurement plans, information on the amount of financial provision for implementation of purchases approved and brought to the customer.

4.6. Compliance of information on identification codes of purchases and about amount of financial provision for implementation of these purchases, containing (subitem 4.2 - 4.6 become effective from 01:01. 2015):

4.9. Justification in documentary drawn up report of impossibility or inexpediency of use of different ways of determination of the supplier (the contractor, the contractor), and also the prices of the contract and other essential terms of the contract in case of implementation of purchase at the single supplier (the contractor, the contractor) for the conclusion of the contract (becomes effective from 01:01. 2017).

4.10. Applications by the customer of measures of responsibility and making of other actions in case of violation by the supplier (the contractor, the contractor) of terms of the contract.

4.11. Compliance of the delivered goods, the performed work (its result) or the rendered service to terms of the contract, purchase goal achievements.

5. Departmental control is exercised within not delegated powers according to part 5 of article 26 of the Law 44-FZ.
