About approval of Rules of determination of the region of activities

1. Approve the enclosed Rules of determination of the region of activities.
2. Recognize invalid:

2) the order of the Minister of Transport and Communications of the Republic of Kazakhstan of August 29, 2013 No. 676 "About modification of the order of the Minister of Transport and Communications of the Republic of Kazakhstan of February 28, 2011 No. 96 "About approval of Rules of determination of the region of activities" (registered in the Register of state registration of regulatory legal acts at No. 8806, No. 319 published on November 20, 2013 in the Kazakhstanskaya Pravda newspaper (27593)).
3. To committee of transport control of the Ministry of Transport and Communications of the Republic of Kazakhstan (Asavbayev A. A.) provide:
1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, official publication in mass media, including on Internet resource of the Ministry of Transport and Communications of the Republic of Kazakhstan and placement it on the intranet portal of state bodies;
3) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction of the copy on official publication in information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";
4) submission to Legal department of the Ministry of Transport and Communications of the Republic of Kazakhstan of data on state registration and about the direction on publication in mass media within 5 working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.
4. To impose control of execution of this order on the vice-Minister of Transport and Communications of the Republic of Kazakhstan Pshembayev M. K.
5. This order becomes effective since October 20, 2014 and is subject to official publication.

1. These rules of determination of the region of activities (further - Rules) are developed according to item 4 of article 88 of the Law of the Republic of Kazakhstan of April 17, 2014 "About traffic".
2. Rules determine procedure for determination of the region of activities of operators of technical inspection for ensuring carrying out obligatory technical inspection of motorized vehicles and trail cars to them (further - TS) in all territory of the Republic of Kazakhstan.
3. The region of activities is determined for the mobile line of technical inspection of the operator of technical inspection by means of creation of the list of names of settlements and regions where there are no stationary lines of technical inspection.
The list of names of settlements and regions where there are no stationary lines of technical inspection (further - the List) is constituted by Committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further - Committee) and is placed on Internet resource: www.miid.gov.kz.
4. The operator of technical inspection (further – the Operator) provides carrying out obligatory technical inspection by stationary and/or mobile lines of technical inspection within administrative-territorial borders of area in the place of the registration.
5. In regions obligatory technical inspection of TS with use of mobile lines of technical inspection is provided with the Operator in the cities of district value, the administrative centers of areas and rural districts where there are no stationary lines of technical inspection.
6. For ensuring carrying out obligatory technical inspection of TS with the operator of technical inspection having the mobile line of technical inspection the schedule of carrying out obligatory technical inspection of TS within the region of activities for form according to appendix to these rules is constituted (further - the Schedule).
7. The mobile line of technical inspection provides carrying out obligatory technical inspection within year according to the Schedule.

14. In case of carrying out obligatory technical inspection of TS of legal entities within civil legal relationship by the Operator application of mobile lines of technical inspection for departure on the territory of the legal entity is allowed, without breaking Schedule, except for carrying out obligatory technical inspection of TS in the capital, the cities of republican and regional value.
