1. Approve the enclosed list of the objects which are not subject to alienation.

2. To the government of the Republic of Kazakhstan to bring the decisions into accord with this Decree.

3. Recognize invalid:

1) the Presidential decree of the Republic of Kazakhstan of July 28, 2000 No. 422 "About the list of objects of state-owned property, not privatizeable" (SAPP of the Republic of Kazakhstan, 2000, No. 29, the Art. 354);

2) the Presidential decree of the Republic of Kazakhstan of February 10, 2003 No. 1021 "About modification of the Presidential decree of the Republic of Kazakhstan of July 28, 2000 No. 422" (SAPP of the Republic of Kazakhstan, 2003, No. 7, the Art. 68).

4. This Decree becomes effective from the date of its signing.

The list of the objects which are not subject to alienation

1. The earth (except that which can be in private property on the bases, conditions and in the limits set by the legislation of the Republic of Kazakhstan), its subsoil, waters, plant and animal life, other natural resources.

2. State supervisory network and its property.

3. Objects of the state natural and reserved fund.

4. Highways public, inland waterways and navigable hydraulic engineering constructions located on them used for navigation, the beacons, devices and navigation signs regulating and guaranteeing safety of navigation, locks, aeronautical devices of governing bodies of air traffic, the engineering networks connected with safety of flights of aircrafts and also the subway.

5. The water management constructions having special strategic importance, determined by the President of the Republic of Kazakhstan.

6. The organizations of health care giving primary health care in the village, the specialized help (the centers of blood, on protection of mother and child, radiation medicine, objects for treatment of the oncological, tubercular, infected HIV and patients with AIDS, infectious, mental patients), the health cares which are the single state organizations in the served territory of the city, the area.

7. Objects of social protection of the population, the organization of education for orphan children and children without parental support, children's homes, sanatoria for children, aged, disabled people, participants of the Great Patriotic War and persons equated to them, boarding schools and hospital, and also the public medico-social institutions (organizations) for aged, disabled people, including handicapped children. 8. The objects and property of Civil defense which are state-owned property and intended for providing actions of civil defense and accomplishment of mobilization tasks and also objects and property of the public fire service.

9. The objects and property which are state-owned property, assigned to the organizations of industries of economy on the right of operational management, economic maintaining and intended for ensuring needs of defense and accomplishment of mobilization tasks, the military property which except for is not used.

10. The military property assigned on the right of operational management to public institutions of Armed Forces, other troops and military forming, the military property which except for is not used.

11. The organizations created or created for ensuring activities of special state bodies.

12. The real estate which is not used by special state bodies in peace time.

13. The documents of National Archive Fund which are in state-owned property and also buildings, rooms and the equipment of the Public Records Offices and their branches.

14. The documents of National kartografo-geodetic fund of the Republic of Kazakhstan which are in state-owned property.

15. The state organizations of primary, main secondary, general secondary education providing in the territory of the Republic of Kazakhstan constitutional rights of citizens on education.

16. The state organizations of culture, objects of national cultural property which are in state-owned property, the historical and cultural monuments which are in the territory of the Republic of Kazakhstan and not belonging to other subjects.
