The government of the Republic of Uzbekistan and the Cabinet of Ministers of Ukraine which further are referred to as with the Parties

recognizing need of ensuring free transit of natural gas irrespective of its origin or its owner,

agreed as follows:

Article 1

1. The Uzbek Side will provide free transit of the Turkmen natural gas across the territory of the Republic of Uzbekistan to consumers of Ukraine in amounts and on the conditions determined by contracts between business entities of Ukraine and Turkmenistan who bear responsibility for their accomplishment.

2. Conditions of transit of the Turkmen natural gas to consumers of Ukraine are determined by separate contracts between business entities of the Parties by gas-transport systems of the Republic of Uzbekistan.

Article 2

Natural gas, trasportiruyemy en route, cannot be used for needs of the Uzbek Side which performs its transit.

Article 3

In case of disputes the Uzbek Side should stop and reduce transit supply of gas from Turkmenistan to Ukraine to the decision of these disputes, except the cases of default on obligations of payment provided by contracts between business entities of the Parties.

Article 4

The procedure for customs control and customs clearance of transit Turkmen gas will be performed according to the customs legislation of the Republic of Uzbekistan.

Article 5

Disputes between the Parties on interpretation and application of provisions of this agreement, and also disputes which affect the rights and obligations of the Parties will be solved by carrying out direct consultations and negotiations between the Parties.

Article 6

By mutual consent of the Parties changes and additions which are drawn up by the separate protocols which are its integral part can be made to this agreement.

Article 7

This agreement becomes effective from the date of the beginning of supply of natural gas by Turkmenistan to consumers of Ukraine through gas-transport systems of the Republic of Uzbekistan and will be effective before the expiration of six months from the date of when one of the Parties informs in writing other Party on the intention to stop its action.

It is made in the city of Kiev on February "19", 1998 in duplicate, everyone in the Uzbek, Ukrainian and Russian languages, at the same time both texts are authentic.

For the purposes of interpretation of provisions of this agreement the text in Russian is used.
