considering mutual interest of the Parties in effective use of source of raw materials, the organization of joint businesses and interstate companies in oil and gas industries, creating favorable conditions for enhancement of the market relations,

wishing to assist long-term and mutually beneficial cooperation in export of the Uzbek natural gas to Ukraine,

agreed as follows:

Article 1

1. The Uzbek Side will provide supply of natural gas to Ukraine, since 1998, in amount to 6 billion cubic meters annually.

2. The Uzbek Side charges to GAZPEKS SA to perform supply of natural gas.

3. Conditions of settlement for delivered gas to Ukraine are determined by separate contracts between National corporation of the oil and gas industry Uzbekneftegaz and GAZPEKS SA.

Article 2

When crossing customs border of the Republic of Uzbekistan of the natural gas delivered from the Republic of Uzbekistan to Ukraine, customs control and customs clearance will be performed according to the customs legislation of the Republic of Uzbekistan.

Article 3

Disputes on interpretation and accomplishment of this Agreement will be solved by consultations and negotiations between the Parties.

Article 4

In the written consent of the Parties changes and additions which are drawn up by the separate protocols which are its integral part can be made to this agreement.

Article 5

This agreement becomes effective in 30 days from the date of signing and stops the action in 6 months from the date of obtaining by one Party of the written notice of other Party of its intention to terminate this agreement.

It is made in the city of Kiev on February "19", 1998 in duplicate, everyone in the Uzbek, Ukrainian and Russian languages, at the same time both texts are authentic.

For the purposes of interpretation of provisions of this agreement the text in Russian is used.
