For the purposes of this Law the following main terms and their determinations are used:
Belarusians of the abroad - persons who are constantly living outside the Republic of Belarus also identify themselves as Belarusians or are natives from the territory of the modern Republic of Belarus;
public associations (organizations) of Belarusians of the abroad - the voluntary associations of Belarusians of the abroad created by them in the procedure established by the legislation of foreign state for the purpose of joint realization of the national, cultural and other rights;
public associations on communications with Belarusians of the abroad - the public associations created in the procedure established by the legislation of the Republic of Belarus for the purpose of assistance to Belarusians of the abroad in realization of their national, cultural and other rights;
state policy of the Republic of Belarus in the field of the relations with Belarusians of the abroad (further - state policy in the field of the relations with Belarusians of the abroad) - package of measures, the Belarusians of the abroad directed to support accepted by state bodies and the organizations of the Republic of Belarus for the purpose of assistance to Belarusians of the abroad in realization of their national, cultural and other rights.
This Law determines the basic principles, the purposes and the directions of state policy in the field of the relations with Belarusians of the abroad for the purpose of ensuring solidarity of Belarusians around the world, preserving national and cultural identity of Belarusians of the abroad and strengthening of their communications with the Republic of Belarus, and also categories of persons belonging to Belarusians of the abroad, and measure of the state support given to Belarusians of the abroad in the Republic of Belarus and beyond its limits.
The legislation of the Republic of Belarus in the field of the relations with Belarusians of the abroad is based on the Constitution of the Republic of Belarus and consists of this Law, other acts of the legislation of the Republic of Belarus, and also international treaties of the Republic of Belarus.
If the international treaty of the Republic of Belarus establishes other rules, than those which are provided by this Law then are applied rules of the international treaty.
The following persons concern Belarusians of the abroad:
the citizens of the Republic of Belarus who are constantly living outside the Republic of Belarus;
the foreign citizens and persons without citizenship who are constantly living outside the Republic of Belarus and or their ancestors on the direct ascending line were born or lived in the territory of the modern Republic of Belarus;
the foreign citizens and persons without citizenship who are constantly living outside the Republic of Belarus also identify themselves as Belarusians from the point of view of ethnic origin to the Belarusian people or Belarusian, culture, historical links, knowledge and respect for the Belarusian traditions and customs.
Recognition by persons of the belonging to Belarusians of the abroad according to paragraphs to the third and fourth part one of this Article is the act of their self-identification supported with public or professional activity on preserving Belarusian, development Belarusian cultures abroad, to strengthening of friendship of the states of civil accessory or the permanent residence of Belarusians of the abroad with the Republic of Belarus and others confirmation of the voluntary choice for benefit of spiritual and cultural communications with the Belarusian state.
Public associations (organizations) of Belarusians of the abroad and public associations on communications with Belarusians of the abroad can:
render assistance in realization of state policy in the field of the relations with Belarusians of the abroad;
bring in state bodies of the Republic of Belarus suggestions for improvement of state policy in the field of the relations with Belarusians of the abroad;
advance the Belarusian cultural values, Belarusian, and also the Belarusian traditions and customs;
perform other activities in the field of the relations with Belarusians of the abroad which are not forbidden by the legislation of the Republic of Belarus.
State regulation and management in the field of the relations with Belarusians of the abroad are performed by the President of the Republic of Belarus, the Government of the Republic of Belarus, the Ministry of Foreign Affairs of the Republic of Belarus, the Ministry of Culture of the Republic of Belarus, the Representative for cases of religions and nationalities, regional and Minsk city executive committees, other state bodies and the organizations of the Republic of Belarus.
The president of the Republic of Belarus determines general state policy in the field of the relations with Belarusians of the abroad, performs other powers according to the Constitution of the Republic of Belarus and other legal acts of the Republic of Belarus.
The government of the Republic of Belarus in the field of the relations with Belarusians of the abroad:
provides realization of general state policy;
approves state programs and exercises control of their realization;
performs other powers according to the Constitution of the Republic of Belarus, this Law, acts of the President of the Republic of Belarus and other legal acts of the Republic of Belarus.
