About the Procedure for the organization and evaluating impact on the environment

According to article 22 of the Law of the Republic of Tajikistan "About environmental assessment" and article 51 of the Law of the Republic of Tajikistan "About regulatory legal acts" the Government of the Republic of Tajikistan decides:

1. Approve the Procedure for the organization and evaluating impact on the environment it (is applied).

2. Declare invalid the Order of the Government of the Republic of Tajikistan of October 3, 2006 No. 464 "About approval of the Evaluation procedure of impact on the environment".

Procedure for the organization and evaluating impact on the environment

1. General provisions

1. This Procedure determines process of evaluating impact on the environment (further - EIA) planned economic and other types of activity (further - the planned activities).

2. In case of consideration of republican and local drafts of industry concepts, forecasts, programs and schemes which implementation is connected with use of natural resources and (or) can make impact on the environment, assessment of impact is performed as strategic ecological assessment.

3. The purposes of evaluating impact are:

- comprehensive consideration of all ecological and related social and economic and other effects of the planned activities before decision making about its realization;

- search of the optimal project solutions promoting prevention or minimization of possible considerable harmful effects of the planned economic activity on the environment;

- acceptance of effective measures for minimization of possible considerable harmful effects of the planned activities on the environment and human health;

- determination of admissibility (inadmissibility) of realization of the planned activities on the chosen parcel of land.

4. The basic principles of assessment of impact are:

- the preventiveness meaning evaluating impact before decision making about realization of the planned activities and use of results of this assessment in case of development of project decisions for providing ecological safety;

- presumption of potential ecological danger of the planned economic activity;

- the alternativeness meaning the analysis of different options of placement and (or) realization of the planned activities including refusal of its realization (zero alternative);

- the complexity meaning total accounting of impact on the environment of the performed and planned activities;

- publicity and accounting of public opinion on questions of impact of the planned activities on the environment:

- the objectivity and scientific justification meaning preparation of the valuation report of impact on the environment without prejudice and professionally;

- the reliability and completeness of information meaning availability in the course of assessment of impact of as much as possible complete information promoting acceptance of ecologically reasoned decisions.

5. Results of assessment of impact are:

- the main conclusions about nature and scales of impact to the environment of alternative options of placement and (or) realization of the planned activities;

- the description of ecological and related social and economic and other effects of realization of the planned activities and assessment of their importance;

- the description of measures for prevention, minimization or compensation of possible considerable harmful effects of the planned activities on the environment and to improvement of social and economic conditions;

- reasons for the choice of the priority site area, the best available technical and other solutions of the planned activities, and also refusal of its realization (zero alternative).

6. When evaluating impact the developer of the project documentation shall use complete, reliable and up-to-date initial information, the confided and accredited means and methods of measurement, and also techniques and calculations approved in accordance with the established procedure for assessment of possible adverse effects of realization of the planned activities for the environment and health of the person.

2. The procedure of evaluating impact on the environment

7. Assessment of impact is carried out when planning economic and other types of activity which can influence environmental protection and health of the person directly or indirectly.

Impact assessment is developed for objects which possibility of impact is high (category objects I) in the form of "The valuation report of impact on the environment". Assessment of impact includes the following stages:

- development and approval of the program of evaluating impact on the environment (further - the program of carrying out EIA);

- development of the valuation report of impact on the environment ^ (further - the report on EIA);

- carrying out discussions of the report on EIA with the public whose rights and legitimate interests can be infringed in case of implementation of project decisions;

- completion of the report on EIA on notes and offers of the public;

- submission of the modifed project documentation on the planned economic activity, including the report on EIA, on the state environmental assessment;

- approval of the project documentation on the planned economic activity, including the report on EIA, in the procedure established by the legislation;

8. The program of carrying out EIA is developed by the project organization for the contract with the customer.

In the program of carrying out EIA report structure about EIA, the schedule, amount and extent of disaggregation of assessment works of impact proceeding from features of the planned activities and complexity of natural, social and technogenic conditions are determined.

9. The program of carrying out EIA shall contain:

- schedule of works on evaluating impact;

- data on the planned activities and alternative options of its realization;

- data on expected methods and techniques of forecasting and assessment which will be used for impact assessment;

- Sections:
