The protocol on mutual recognition of the property rights to the objects of the social sphere created at the expense of means of the Republic of Uzbekistan and the Kyrgyz Republic

The governments of the State Parties of the this Protocol which are hereinafter referred to as "Party"

confirming the aspiration to build the economic relations on the basis of mutual respect of property rights of each of the Parties, agreed as follows:

Article 1

The parties came to the agreement on need of recognition in the territories of existence of the companies and objects of the social sphere which are property of the State Parties of the this Protocol.

The objects considered in this Protocol are sanatoria, sanatoria dispensaries, houses and recreation facilities, boarding houses, hotels and campings, tourist and transshipment facilities, child care improving facilities. Other objects of the social sphere can be subject of this Protocol of the mutual arrangement of the Parties.

Article 2

The parties will promote creation in their territory of the objects of the social sphere belonging to legal entities and physical persons of the State Parties of the Protocol including joint.

Article 3

The parties came to need of recognition that the companies and objects (or respective shares of participation) the social sphere which are earlier created at the expense of means of republican budgets, and also means of the companies and the organizations of republican and former allied subordination being in the territory of other states are property of the states or financing their creation or which possess the above-stated companies and the organizations of republican and former allied subordination.

Article 4

The parties reached agreement on need to guarantee the free translation (after tax payment and charges, stipulated by the legislation the states of the location object) legally gained cash incomes and payments of the joint objects and objects which are property of other State Parties of the protocol, them (physical persons and legal entities.

Article 5

Article 7

The parties confirm that the property right concerning the objects of the social sphere belonging to legal entities and physical persons of the State Parties of the Protocol uses the complete and unconditional legal protection provided with the state in the territory of which there are specified objects and contracts between the Parties.

Article 8

The parties came to the agreement on need of the conclusion till March 1, 1994 of the intergovernmental agreement about mutual recognition of the rights and regulation of the relations of property of legal entities and physical persons of the State Parties of the this Protocol.

Article 9

Disputes on interpretation and application of regulations of the this Protocol are subject to consideration by negotiations between relevant organs of the Parties.

It is made in Tashkent on February 2, 1994 in two authentic copies in the Uzbek, Kyrgyz and Russian languages.
