About approval of Rules of the organization and evaluating degree of risks of the operated roads in the territory of the Republic of Kazakhstan

According to the subitem 12) article 10 of the Law of the Republic of Kazakhstan of April 17, 2014 "About traffic" PRIKAZYVAYU:

1. Approve the enclosed Rules of the organization and evaluating degree of risks of the operated roads in the territory of the Republic of Kazakhstan.

2. To provide to committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its official publication in periodic printed publicity materials and in information system of law of Ad_let;

3) placement on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan.

3. To impose control of execution of this order on the deputy minister of internal affairs of the police major general Turgumbayev E. Z.

4. This order is subject to official publication and becomes effective since October 19, 2014.

Rules of the organization and evaluating degree of risks of the operated roads in the territory of the Republic of Kazakhstan

1. These rules of the organization and evaluating degree of risks of the operated roads in the territory of the Republic of Kazakhstan (further – Rules) are developed according to the Law of the Republic of Kazakhstan of April 17, 2014 "About traffic" and determine procedure for the organization and evaluating degree of risks of the operated roads of the international, republican, regional and district value in the territory of the Republic of Kazakhstan (further – highways).

2. Assessment of risk degree of the operated highways is carried out for the purpose of receipt of information on the actual risk level of operation of highways and use of this information for quality management of content of highways.

3. Assessment of risk degree of the operated highways is established by the service employee of authorized body on traffic safety control (further - the service employee).

3-1. To chiefs of Departments of police of the cities of Nour-Sultan, Almaty, Shymkent and areas, representative offices of the Ministry of Internal Affairs of RK in the city of Baikonur:

1) to provide studying and observance of requirements of this order by staff of law-enforcement bodies;

2) to organize work of law-enforcement bodies according to requirements of this order.

4. Rules establish the following estimates of risk degree of the operated highways:

1) low (5 points) - content of the highway provides maintenance of consumer properties of the highway at the level above average. The highway, each its structural element and their components contain in the condition providing the round-the-clock, uninterrupted and safe movement of vehicles which is not allowing reduction in the rate of movement of the vehicles for the reasons connected with content of the highway. There are no road accidents on road conditions (further - road accident of DU), the highways depending on defects.

2) average (4 points) - content of the highway provides maintenance of consumer properties of the highway at the level above admissible. The condition of structural elements of the highway and their components depending on content does not cause the necessity of temporary restriction or traffic congestion of vehicles. There are no road accident of DU depending on defects of highways.

3) admissible (3 points) - content of the highway provides the admissible level of traffic security. The temporary restriction or traffic congestion of vehicles on certain sites under the terms of their content in case of adverse weather climatic conditions is allowed. There are no road accident of DU depending on defects of highways.

4) inadmissible (2 points) - content of the highway does not provide the admissible level of traffic security. The road accident of DU depending on defects of highways is fixed and (or) the inadmissible level of content of highways leading to traffic congestion of vehicles on certain sites is fixed.

5. The service employee appoints assessment of risk degree of the operated highways at any time, but at least two times a year throughout the highway about what it directs the notification of the organization servicing this section of the highway based on the agreement (further - the organization). The service employee carries out assessment of risk degree of the operated highways after 72 hours from the moment of receipt of the notification by the organization.

The service employee carries out selective assessment of risk degree of certain sections of the highway.

6. Two consecutive periods of assessment of risk degree of the operated highways - winter and spring and aestivo-autumnal are seasonally established.

7. The minimum section of the highway on which assessment of risk degree of the operated highways is carried out is equal to one kilometer.

In case of absence on the highway of kilometer sign the site length one kilometer is traced on the vehicle odometer.

If the extent of the highway constitutes not the whole number of kilometers, the last not whole kilometer is evaluated as independent kilometer if its length is equal or more than five hundred meters, and is included in case of assessment of the last whole kilometer if its length less than five hundred meters.

Length of artificial road features on which assessment of risk degree of the operated highway is performed is determined depending on their extent.

8. Are not subject to assessment of risk degree (on condition of application of appropriate means of the organization of traffic):
