About safety and qualities of foodstuff

(as amended on 25-11-2017)

This Law establishes legal, organizational and economic basis of safety and quality of foodstuff and is directed to public health care of Turkmenistan.

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) food staples – raw materials of plant, animal, microbiological, mineral and artificial origin, and also the water used for production of foodstuff;

2) identification of the foodstuff, materials and products contacting to foodstuff – activities for establishment of compliance of the foodstuff, materials and products contacting to foodstuff, to requirements of regulating documents, information on the foodstuff, materials and products contacting to foodstuff, containing in the documents attached to them and on labels;

3) batch of foodstuff – set of the units of food staples and the foodstuff, materials and products contacting to foodstuff, made (developed) and packed in identical conditions and accompanied with the document certifying their quality;

4) dietary foods – the products of treatment-and-prophylactic power supply intended for certain categories of persons at which processes of digestion or metabolism are broken or which are in special physiological conditions;

5) dietary supplements – natural (identical natural) biologically active agents intended for the use along with food or introductions in structure of foodstuff;

6) infant foods – the foodstuff intended for power supply of children aged up to fourteen years and meeting physiological requirements of children's organism;

7) counterfeited foodstuff – foodstuff with intentionally changed by the structure, properties and characteristics worsening their nutrition value, involved in turnover, information on which is obviously incomplete or doubtful;

8) genetically modified organisms (microorganisms) – organisms, microorganisms which genotypes were artificially changed by means of methods of genetic engineering;

9) foodstuff – the products of plant, animal, biological, mineral or artificial origin in the natural or processed type used by the person (including products of baby and dietary food), butylated drinking water, alcoholic products (including beer), soft drinks, chewing gum, ferments, starting cultures of microorganisms, food staples, food and dietary supplements, except for cosmetic products, tobacco products and substances used only as medicines;

10) food supplements – the natural or artificial substances and their connections entered into foodstuff in the course of their production for the purpose of giving to foodstuff of certain properties and (or) preserving their quality;

11) the materials and products contacting to foodstuff (further – materials and products), – the materials and products applied to production and turnover of foodstuff including processing equipment, devices and devices, container, ware, dining facilities;

12) materials for packaging of foodstuff – the materials serving for production of consumer pack for foodstuff;

13) quality of foodstuff – set of characteristics of the foodstuff providing compliance of their nutrition value to requirements of the regulating documents and capable to satisfy physiological needs of the person for food in case of usual conditions of their use;

14) safety of foodstuff – compliance of foodstuff to requirements of this Law, the regulating documents guaranteeing in case of the use of foodstuff lack of risk of damnification of life and to health of the person, his heredity;

15) nutrition value of foodstuff – set of properties of the foodstuff satisfying physiological needs of the person for necessary substances and energies;

16) the certificate of quality of foodstuff – the document in which the producer certifies compliance of quality of each batch of foodstuff to requirements of regulating documents;

17) turnover of foodstuff, materials for packaging of foodstuff – the process connected with procurement, purchase, delivery, storage, transportation and realization of foodstuff, materials for packaging of foodstuff;

18) production of foodstuff, materials for packaging of foodstuff – the serial release of foodstuff, materials for packaging of foodstuff which is characterized by availability of processing lines, production equipment and workshops, the production schedule of foodstuff, contracts for their delivery;
