About approval of the Regulations on military units of operational appointment of National guard of Ukraine

According to Article 2, "About National guard of Ukraine" and for the purpose of determination of the legal basis of the organization and procedure for activities of military units of operational appointment of National guard of Ukraine, their legal status, functions and powers I ORDER to part six of article 5 of the Law of Ukraine:

1. Approve Regulations on military units of operational appointment of National guard of Ukraine which are applied.

2. To head department of National guard of Ukraine (Poltorak S. T.) provide submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. To impose control of execution of this order on the deputy minister of the lieutenant general of Summer S. A.

4. This order becomes effective from the date of its official publication.

Regulations on military units of operational appointment of National guard of Ukraine

I. General provisions

1.1. This Provision determines appointment, the main objectives, functions, legal status of military units of operational appointment of National guard of Ukraine.

1.2. Military units of operational appointment of National guard of Ukraine (further - military units) are created within the number of National guard of Ukraine and societies and the states from criminal and other illegal encroachments, protection of public order and ensuring public safety, and also in interaction with law enforcement agencies - on ensuring state security and protection of frontier, suppression of terrorist activities, activities of the illegal militarized or paramilitary groups (groups), the terrorist organizations, organized groups and the criminal organizations are intended for accomplishment of tasks on protection and protection of life, the rights, freedoms and legitimate interests of citizens.

1.3. In the activities military units are guided by the Constitution of Ukraine, the Law of Ukraine "About National guard of Ukraine", other laws, international treaties which consent to be bound is provided by the Verkhovna Rada of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, regulatory legal acts of the Ministry of Internal Affairs of Ukraine, orders, directives, orders and orders of the commander of National guard of Ukraine, and also this Provision.

II. Tasks and functions of military units

2.1. The main objectives of military units is protection and protection of life, the rights, freedoms and legitimate interests of citizens, societies and the states from criminal and other illegal encroachments, protection of public order and ensuring public safety, and also in interaction with law enforcement agencies - ensuring state security and protection of frontier, suppression of terrorist activities, activities of the illegal militarized or paramilitary groups (groups), the terrorist organizations, organized groups and the criminal organizations.

Military units during execution of tasks perform:

protection of the constitutional system of Ukraine, integrity of its territory against change attempts in their violent way;

actions of territorial defense.

Military units during execution of tasks take part in:

implementation of the actions connected with the termination of armed conflicts and other provocations on frontier and also measures for non-admission of mass transition of frontier from the territory of the adjacent states;

special transactions on neutralization of the armed criminals, the terminations of activities of the militarized or paramilitary groups (groups), organized groups and the criminal organizations which are not provided by the law in the territory of Ukraine, and also in the actions connected with the termination of terrorist activities;

the termination of the mass riots which are followed by violence over citizens;

maintenance or recovery of law and order in areas of emergence of especially difficult emergency situations of technogenic or natural nature (natural disaster, catastrophic crashes, heavy fires, use of weapons of destruction, pandemics, panzootics other) creating threat of life and to health of the population;

recovery of the constitutional law and order when implementing attempts of capture of the government or change of the constitutional system by violence, recovery of activities of public authorities, local government bodies;

ensuring public safety and protection of public order during the meetings, meetings, processions, demonstrations and other mass actions creating danger to life and health of citizens;

recovery of law and order in case of the international and interfaith conflicts, unblocking or the termination of illegal actions in case of capture of important state objects or areas, the menacing safety of citizens and breaking normal activities of public authorities and local government bodies;

implementation of actions of legal regime of warlike and emergency state.

2.2. Military units according to the tasks assigned to them shall:

1) to provide protection and protection of life, the rights, freedoms and legitimate interests of citizens, societies and the states from criminal and other illegal encroachments;

2) to take measures for suppression of activities of the illegal militarized or paramilitary groups (groups), the terrorist organizations, organized groups and the criminal organizations;

3) to be involved in anti-terrorist operations;

4) to take measures for detention of the persons suspected of making of criminal offense, persons, who made escape from places of detention, deserters;

5) to participate in the actions connected with the termination of armed conflicts and other provocations on frontier and also in actions for non-admission of mass transition of frontier from the territory of the adjacent states;

6) to take part in recovery of the constitutional law and order broken in attempts of capture of the government or change of the constitutional system by violence, and also in recovery of activities of public authorities, local government bodies, initiated owing to making of illegal actions, including on the basis of the international and interfaith conflicts;
