About approval of Rules of payment of pension and social insurance of the Russian Federation by Fund to legal successors of the died insured persons of means of the pension accruals considered in special part of individual personal accounts

1. Approve the enclosed Rules of payment of pension and social insurance of the Russian Federation by Fund to legal successors of the died insured persons of means of the pension accruals considered in special part of individual personal accounts.

2. Declare invalid the order of the Government of the Russian Federation of November 3, 2007 No. 741 "About approval of Rules of payment by the Pension Fund of the Russian Federation to legal successors of the died insured person of means of the pension accruals considered in special part of individual personal account" (The Russian Federation Code, 2007, No. 46, the Art. 5580).

3. To make to the Ministry of Labour and Social Protection of the Russian Federation explanations about application of the Rules approved by this resolution.

4. This resolution becomes effective since January 1, 2015.

Rules of payment of pension and social insurance of the Russian Federation by Fund to legal successors of the died insured persons of means of the pension accruals considered in special part of individual personal accounts

I. General provisions

1. These rules determine procedure for the request of legal successors of the died insured persons for payment of means of the pension accruals considered in special part of individual personal accounts, procedure, terms and frequency of implementation of the specified payments and procedure of payments of their amounts.

Action of these rules extends to legal successors of the died insured persons whose forming of funded pension for date of their death was performed through Fund of pension and social insurance of the Russian Federation (further - Fund).

2. In these rules the following basic concepts are used:

"legal successors" are legal successors according to the statement and legal successors under the law;

"legal successors according to the statement" - persons specified in the statement for distribution of means of pension accruals;

"legal successors under the law":

relatives of the died insured person by whom payment of means of pension accruals (except for means (part of the means) of the maternity (family) capital directed to forming of funded pension, and result of their investment) the died insured person is made irrespective of age and condition of working capacity in the following sequence:

first of all - the children including adopted the spouse (spouse) and parents (adoptive parents) (legal successors under the law of the first priority);

at second priority - brothers, sisters, grandfathers, grandmothers and grandsons (legal successors under the law of second priority);

persons specified in item 4 of these rules concerning balance (part of the means) of the maternity (family) capital directed to forming of funded pension, and result of their investment which is not paid to the died insured person in the form of due retirement benefit;

"the statement for distribution of means of pension accruals" - the statement of insured person for determination of persons by which in case of his death payment of means of the pension accruals considered in special part of its individual personal account (except for means (part of the means) of the maternity (family) capital directed to forming of funded pension, and result of their investment), and about procedure for distribution between them the specified means in form according to appendix No. 1 can be made;

"the statement for payment of means of pension accruals" - the statement of the legal successor for payment of means of the pension accruals considered in special part of individual personal account of the died insured person in form according to appendix No. 2;

"the declaration of abandonment of receipt of means of pension accruals" - the statement of the legal successor for refusal of receipt of the means of the pension accruals considered in special part of individual personal account of the died insured person which are due to it in form according to appendix No. 3;

"the decision on payment of means of pension accruals" - the decision of territorial authority of Fund for the residence of the died insured person on allowance of the application on payment of means of pension accruals for the form approved by the Ministry of Labour and Social Protection of the Russian Federation;

"the decision on additional payment of means of pension accruals" - the decision of territorial authority of Fund for the residence of the died insured person on payment to legal successors of means of the pension accruals intended for additional payment in the form approved by the Ministry of Labour and Social Protection of the Russian Federation;

"the decision on refusal in payment of means of pension accruals" - the decision of territorial authority of Fund for the residence of the died insured person on refusal in allowance of the application about payment of means of pension accruals for the form approved by the Ministry of Labour and Social Protection of the Russian Federation;

"the means of pension accruals intended for additional payment" - the means of pension accruals considered in special part of individual personal account of the died insured person for the period, expired from the date of decision about payment of means of pension accruals, and consisting of insurance premiums for financing of funded pension (including the insurance premiums listed by the insurer in year of death of insured person), additional insurance premiums for funded pension, fees of the employer paid to advantage of insured person, net financial result of temporary placement by Fund of the specified insurance premiums and fees of the employer, fees for joint financing of forming of the pension accruals which arrived according to the Federal Law "About Additional Insurance Premiums for Funded Pension and the State Support of Forming of Pension Accruals" and result of investment of means of pension accruals, and also consisting of balance (part of the means) of the maternity (family) capital directed to forming of funded pension, and result of their investment which is not paid to the died insured person in the form of due retirement benefit.

3. Legal successors, except for persons specified in item 4 of these rules have the right to means of the pension accruals of the died insured person considered in special part of its individual personal account (except for means (part of the means) of the maternity (family) capital directed to forming of funded pension, and result of their investment) if the death of insured person came before appointment to it funded pension and (or) due retirement benefit or before adjustment of the size of the specified pension and (or) adjustment of due retirement benefit taking into account additional pension accruals.
