1. Approve Quality requirements and to trade in seeds of grain grains of cultures (are applied).

2. This resolution becomes effective after 6 months from the date of its publication in the Official monitor of the Republic of Moldova.

3. To impose control of execution of this resolution on the National agency on safety of foodstuff.

Quality requirements and trade in seeds of grain grains of cultures

These Requirements partially shift the Directive of Council No. 66/402 EEC of June 14, 1966 about trade in seeds of grain crops published in the Official magazine of the European Community (JO, L, 125, of July 11, 1966), with the last amendments made by the Directive on its application 2012/37/EU Commissions of November 23, 2012 (JO L 32 of February 6, 2007).

I. Scope

1. Quality requirements and trade in seeds of grain grains of cultures (further – Requirements) are applied to seeds of types of the plants (further – seeds) specified in appendix No. 1 to these Requirements which shall be observed in case of their production and/or trade.

2. These Requirements are not applied to the seeds made in individual farms, and also to transit seeds, or temporarily stored in warehouses as transit products.

II. Terminology

3. In sense of these Requirements the used terms mean:

1) grain – plants of the types described in appendix No. 1 to these Requirements, intended for agricultural or gardening production, except for the decorative purposes;

2) realization – sale, storage with sales objective, the offer on sale and any kind of concession, delivery or transfer of seeds to other party for commercial use;

3) official measures - the measures taken by responsible official organ;

4) responsible official organ - The national agency on safety of foodstuff;

5) post-control – control of identity and varietal purity of seeds.

4. In sense of these Requirements the following categories of seeds are determined:

1) category seeds basic – the seeds answering to the conditions specified in appendices No. 2 and 3 to these Requirements, which:

a) in case of seeds of oats, barley, rye, triticale, soft wheat, durum wheat and spelled, other than corresponding hybrids, are made by sokhranitel or under its direct responsibility concerning grade, according to rules of conservative selection, and are intended for production of the certified seeds, the certified seeds of the first generation or the certified seeds of the second generation;

b) in case of hybrids of oats, barley, rye, soft wheat, durum wheat, spelled and autogamic triticale, are intended for production of hybrids;

2) the category seeds certified – seeds, which:

a) come directly from category seeds basic or, upon the demand of the selector, from seeds of prior generation of basic seeds of the known grade which answer in case of official examination to the conditions established in appendices No. 2 and 3 to these Requirements;
