1. Approve the enclosed Rules of operating by material values of the state material reserve.

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective from the date of its signing and is subject to official publication.

Rules of operating by material values of the state material reserve

Chapter 1. General provisions

1. These rules of operating are developed by material values of the state material reserve (further – Rules) according to the laws of the Republic of Kazakhstan "About emergency state", "About civil protection" (further – the Law "About Civil Protection") and "About defense industry and the state defense order" and determine procedure for delivery, storage and release of material values of the state material reserve.

2. In these rules the following concepts are used:

1) authorized body in the field of civil protection – the central executive body performing management and cross-industry coordination, development and realization of state policy in the field of civil protection regarding the prevention and liquidation of emergency situations of natural and technogenic nature, rendering emergency medical and psychological assistance to the population, ensuring fire safety and the organization of civil defense;

2) razbronirovaniye – release of material values from the state material reserve in case of change of the nomenclature, and also for utilization or destruction, taking measures to the prevention and liquidation of emergency situations and their effects, rendering the regulating impact on the market, the help to refugees and the humanitarian assistance;

4) authorized body in the field of health care – the central executive body performing management and cross-industry coordination in the field of protection of public health of the Republic of Kazakhstan, medical and pharmaceutical science, medical and pharmaceutical education, sanitary and epidemiologic wellbeing of the population, drug circulation and medical products, qualities of rendering medical services (help);

5) mobilization reserve – the inventory of material values according to the limited nomenclature which is component of the state material reserve necessary for accomplishment of the mobilization order in case of mobilization, warlike situation and in wartime, taking measures to the prevention and liquidation of emergency situations of natural, technogenic and social nature and their effects, humanitarian assistance in peace time, and also material means of special forming;

6) the plan of operating of mobilization reserve – the document regulating delivery, storage and release of material values of mobilization reserve, and also realization of the utilized goods;

7) the state body performing mobilization task – the central executive body performing mobilization task or from which the mobilization task is removed;

8) the state defense order – the legal act of the Government of the Republic of Kazakhstan approving the list (nomenclature) of goods of military (products), goods (products) of dual purpose (application), military works and military services, acquired for needs of defense, safety and law and order in the state, activities of special state and law enforcement agencies of the Republic of Kazakhstan, the state material reserve, mobilization, space activities, and also accomplishment by the Republic of Kazakhstan of international treaties and obligations;

9) the state material reserve – the inventory of material values intended for mobilization needs, taking measures to the prevention and liquidation of emergency situations of natural, technogenic and social nature and their effects, rendering the regulating impact on the market, the help to refugees and the humanitarian assistance;

10) the subordinated organization of system of the state material reserve (further – the subordinated organization) – the legal entity performing forming and storage of material values of the state material reserve;

11) authorized body in the field of the state material reserve (further – authorized body) – the central executive body performing executive and control functions, and also management of system of the state material reserve;

12) borrowing of material values from the state material reserve – release of material values from the state material reserve under certain conditions with the subsequent return to the state material reserve according to the nomenclature and amounts of storage;

13) refreshening of the state material reserve – release of material values from the state material reserve before the expiration of fixed terms of their storage in case of simultaneous or with gap in time to laying of material values according to the nomenclature and amounts of storage;

14) Items of storage of material values of the state material reserve (further – storage Items) – the legal entities performing storage of material values of the state material reserve and rendering the services connected with storage on contractual basis;

15) the nomenclature and amounts of storage of material values of the state material reserve (further – the nomenclature) – the list and amounts of material values of the state material reserve necessary for accomplishment of objectives before authorized body;

16) the plan of operating of the state reserve – the document regulating delivery, storage and release of material values of the state reserve, and also realization of the utilized goods;
