2. Recognize invalid:

1) the order of the Government of the Republic of Kazakhstan of January 16, 2012 No. 70 "About approval of Rules of purchase of electrical energy from the qualified power making organizations" (SAPP of the Republic of Kazakhstan, 2012, No. 24, the Art. 337);

2) the order of the Government of the Republic of Kazakhstan of June 7, 2012 No. 756 "About modification of the order of the Government of the Republic of Kazakhstan of January 16, 2012 No. 70 "About approval of Rules of purchase of electrical energy from the qualified power making organizations" (SAPP of the Republic of Kazakhstan, 2012, No. 55, the Art. 756).

1. General provisions

1. These rules of centralized purchase and sale by settlement financial center of the electrical energy made by objects for use of renewable energy resources (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 4, 2009 "About support of use of renewable energy resources" (further - the Law) and determine procedure for centralized purchase and sale by settlement financial center by support of renewable energy resources of the electrical energy made by the power making organizations using renewable energy resources (further - RES), in the territory of the Republic of Kazakhstan.

2. In these rules the following basic concepts are applied:

1) the device of commercial accounting - the technical device intended for commercial accounting of electrical energy, allowed for use according to the procedure, established by the legislation of the Republic of Kazakhstan;

2) month of delivery - the calendar month of the actual delivery of electrical energy from objects for use of RES beginning the first day of the corresponding month;

3) settlement financial center on support of renewable energy resources (further - settlement financial center) - the legal entity created by the system operator and determined by the Government of the Republic of Kazakhstan, performing according to the procedure, provided by the Law, centralized purchase and sale of the electrical energy made by objects for use of RES and delivered in power networks of single electric utility system of the Republic of Kazakhstan;

4) flat fare - rate for purchase by settlement financial center according to the procedure, established by the Law, the electrical energy made by objects for use of RES;

5) the purchase agreement of electrical energy settlement financial center on support of renewable energy resources (further - the purchase agreement) - the standard agreement of purchase and sale of the electrical energy made by objects for use of RES, concluded between the settlement financial center acting as the buyer and the power making organization acting as the seller;

6) the sales agreement of electrical energy settlement financial center on support of renewable energy resources (further - the sales agreement) - the standard agreement of purchase and sale of the electrical energy made by objects for use of RES, concluded between the settlement financial center acting as the seller and the conditional consumer acting as the buyer;
