RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

About approval of the Regulations on procedure for calling of foreign not public vessels and warships in internal waters, ports (on raids) the Republic of Uzbekistan and stay in them

According to article 26 of the Law of the Republic of Uzbekistan "About Frontier of the Republic of Uzbekistan" and in pursuance of the Resolution of the President of the Republic of Uzbekistan of July 15, 2013 No. PP-2003 "About approval of plans of development of the normative and legal and other acts directed to realization of referential regulations of the laws" the Cabinet of Ministers decides:

1. Approve Regulations on procedure for calling of foreign not public vessels and warships in internal waters, ports (on raids) the Republic of Uzbekistan and stay in them according to appendix.

2. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan B. I. Zakirov.

Regulations on procedure for calling of foreign not public vessels and warships in internal waters, ports (on raids) the Republic of Uzbekistan and stay in them

I. General provisions

1. This Provision determines procedure foreign not public vessels and warships of peaceful pass through territorial waters of the Republic of Uzbekistan, and also procedure for calling and stay in internal waters and ports (on raids) the Republic of Uzbekistan.

2. In this Provision the following basic concepts are used:

internal waters - the part of waters of the rivers, lakes and other reservoirs limited to the line of frontier which coast belong to the Republic of Uzbekistan;

warships - the vessels which are belonging to armed forces of any state, having the external signs distinguishing their nationality, being under command of the officer who is in the service of the government of this state and which surname is entered in the list of the military personnel;

forced calling - calling in territorial or in internal waters of other state, performed owing to force majeure: accidents, the natural disaster or whole gale menacing to safety of the vessel, need of towage of the damaged courts, deliveries of the salvaged people, rendering urgent medical care to the crew member or passenger and also in other similar cases;

calling - stay of foreign not public vessels and warships in internal waters, ports (on raids) the Republic of Uzbekistan with permission, or by the invitation;

pilot service - the special service intended for pilotage and the ships to the port or on base and also in those places where exact knowledge of the area and conditions when swimming is required;

not public vessels - the self-propelled or not self-propelled floating constructions used for the purpose of navigation and performing transportation of goods, passengers and their baggage, mailings, towage of courts and other floating objects;

ports - the ports which are in the territory of the Republic of Uzbekistan;

pass - navigation of vessels through territorial waters of the coastal states or with the purpose to cross these waters, without coming into internal waters and without becoming on raid or at port installation outside internal waters, or with the purpose to pass in internal waters or to leave them;

raid - the part of port area intended for the anchor parking of courts and freight handling the place of the anchor parking of courts near the coast or on approaches to port where vessels expect approach to the mooring or is made by cargo and passenger operations;

territorial waters - the waters which are adjoining the overland territory or internal waters of the state, being part of its territory and being under its sovereignty.

3. Foreign not public vessels and warships during pass, swimming and stay in internal waters and ports (on raids) the Republic of Uzbekistan shall fly the naval or national flag.

Rise and descent of flag on the foreign not public vessel and the warship during the parking in port can be made according to their national legal systems.

4. Foreign not public vessels and warships during pass, swimming and stay in internal waters and ports (on raids) the Republic of Uzbekistan shall follow rules: boundary, customs, tax (fiscal), sanitary, immigration, veterinary, phytosanitary, navigation, maintenance of the mode of radio communication, exchange of information and other rules of the Republic of Uzbekistan.

5. Transportation of goods, passengers and their baggage, arms, military equipment, military property, the military contingents and transit of exceptional loads by foreign not public vessels and warships through territorial waters of the Republic of Uzbekistan is performed according to the legislation of the Republic of Uzbekistan if other is not provided in international agreements of the Republic of Uzbekistan.

6. In case of forced non-compliance with rules of pass, swimming and stay in internal waters and ports (on raids) the Republic of Uzbekistan the captain of the foreign not public vessel or the commander of the warship shall report immediately about it in accordance with the established procedure to border troops of Service of state security of the Republic of Uzbekistan (further - border troops).

7. During pass, swimming and stay in internal waters and ports (on raids) the Republic of Uzbekistan foreign not public vessels or warships shall use services of pilot service in those areas where pilot posting is obligatory.

8. In internal waters of the Republic of Uzbekistan foreign not public vessels or warships shall not come into areas to which according to the solution of border troops are prohibited to them pass, swimming and stay.

9. In case of non-compliance by the foreign not public vessel or warship, its watercrafts or staff of requirements of the legislation of the Republic of Uzbekistan during pass, swimming and stay in internal waters and ports (on raids) the Republic of Uzbekistan on the captain of this not public vessel or the commander of the warship border troops impose requirements about their obligatory observance.

II. Pass of foreign not public vessels and warships to internal waters and ports (raids)

10. Foreign not public vessels and warships have the pass right in case of the observance of conditions of this provision and the relevant standards of the legislation of the Republic of Uzbekistan relating to the mode of pass, swimming and stay in internal waters and ports (on raids) the Republic of Uzbekistan, and also international agreements of the Republic of Uzbekistan.

11. Pass to internal waters is peace if it does not violate the law and safety of the Republic of Uzbekistan, and shall be continuous and bystry.

12. When implementing pass through internal waters or calling internal waters and ports (on raids) the Republic of Uzbekistan any of the following types of activity is forbidden to foreign not public vessels and warships:
