The agreement between state members of the Shanghai Cooperation Organization on cooperation in fight against drug trafficking, psychotropic substances and their precursors

The state members of the Shanghai Cooperation Organization (SCO) which further are referred to as with the Parties

expressing concern in expansion of scales of illicit trafficking in drugs and psychotropic substances (further - drugs) and abuses of them, and also their precursors,

understanding that drug trafficking, and also their precursors pose serious health hazard and to welfare of the people of the Parties,

being concerned about expansion of use of the territories of the Parties of this agreement for smuggling and illegal transit of drugs and their precursors,

considering that strengthening of cooperation of Parties to the case of fight against drug trafficking and abuse of them is equitable to interests of the people of state members of SCO,

in view of provisions of the Charter of the Shanghai Cooperation Organization of 2002, the Single Convention on drugs of 1961 with the amendments introduced in it according to the Protocol of 1972 on amendments to the Single Convention on drugs of 1961, the Convention on psychotropic substances of 1971, the Convention of the United Nations on fight against the illicit trafficking in drugs and psychotropic substances of 1988, the Political declaration and the decision accepted by the XX special session of the United Nations General Assembly in 1998 and also other decisions and recommendations of the UN concerning the matter

proceeding from mutual interest in acceptance of the effective measures directed to fight against drug trafficking and their precursors

being guided by the national legal system and the conventional principles and rules of international law,

agreed as follows:

Article 1

The parties according to the national legal system cooperate in case of development of the approved strategy and joint efforts of fight against drug trafficking and their precursors, coordinate the activities in this direction within SCO, combine efforts of all state bodies, public and other organizations, citizens, and also use possibilities of mass media for the purpose of counteraction of drug addiction and to drug trafficking and their precursors.

The parties promote development of international cooperation in the field of counteraction to drug trafficking and their precursors, counteraction and treatment of drug addiction on bilateral and multilateral basis.

The parties aim to speak from the approved line items at the international forums concerning fight against drug trafficking and their precursors, and also interact with the international organizations operating in the field of fight against drug trafficking and their precursors.

Article 2

1. The parties, cooperating in counteraction to drug trafficking and their precursors, and also to abuse of drugs, are guided by the following basic principles:

state regulation of all types of activity connected with drug trafficking and their precursors;

ensuring inevitability of punishment for the offenses connected with drug trafficking and their precursors;

priority of measures of prevention of drug addiction and the offenses connected with drug trafficking and their precursors;

the state support of scientific research in the field of development of new methods of treatment of drug addiction and medico-social resettlement of patients with drug addiction.

2. The parties according to their national legal system can establish responsibility for not medical consumption of drugs as preventive warning facility of drug addiction and decrease in demand for drugs.

Article 3

The parties perform cooperation in the field of counteraction to drug trafficking and their precursors, and also to abuse of drugs in the following main directions:

the analysis of condition of the crime connected with drug trafficking and their precursors;

establishment of strict control of drug trafficking and their precursors;

implementation of agreed measures for accomplishment of provisions of the conventions and other international treaties directed to fight against drug trafficking and their precursors;

organization of interaction of competent authorities of the Parties for fight against drug trafficking and their precursors;

development of joint programs of counteraction of drug addiction, to drug trafficking and their precursors;

enhancement of the legal base of cooperation of the Parties in fight against drug trafficking and their precursors, harmonization of national legal systems in this area taking into account provisions of international treaties;

prevention of drug addiction, development and deployment of new methods of treatment, social and medical resettlement of patients with drug addiction;

prohibition of the promotion and advertizing promoting spread of drug addiction.

Article 4

1. The parties perform cooperation in the field of counteraction to drug trafficking and their precursors, and also to abuse of drugs in the following forms:

a) exchange of information concerning counteraction to drug trafficking and their precursors, including relatively:

any connected with drug trafficking and their precursors of the crimes committed or prepared for making in the territories of the Parties;

persons suspected of participation in drug trafficking and their precursors;

the concrete facts and events connected with illicit movement or intentions of rather illicit movement of drugs and their precursors from the territory of one Party on the territory of other Party;

structures, members, field of activity, the organization of management and bonds of criminal groups which are involved in drug trafficking and their precursors and which activities have transnational character;

taking place or expected contacts between the individuals and criminal groups connected with drug trafficking and their precursors and acting in the territories of the Parties;

forms and methods of implementation of the criminal activities connected with drug trafficking and their precursors;

the activities directed to legalization (washing) of income gained from drug trafficking and their precursors;

forms and methods of identification of sources of drugs and their precursors in illicit trafficking and measures of restraint of such illicit trafficking;

the methods of concealment and masking of the drugs and their precursors which are in illicit trafficking applied by offenders and methods of their identification;

other questions which are of mutual interest;

b) carrying out by one Party on requests of other Party of investigation and search operations on the questions connected with drug trafficking and their precursors;

c) interaction when holding the actions directed to counteraction to drug trafficking and their precursors including when carrying out controlled deliveries;

d) work experience exchange, including by holding meetings, conferences and seminars;

e) exchange of legislative and other regulatory legal acts, materials about practice of their execution, statistical data and methodical recommendations about questions of counteraction to drug trafficking and their precursors;

e) preparation and advanced training of the corresponding personnel;
