About additional measures for realization of objects of state-owned property to subjects of small business and private entrepreneurship

For the purpose of the ensuring rational and effective use of state-owned property, realization which are not used and incomplete construction of facilities of state-owned property, the released parcels of land to subjects of small business and private entrepreneurship for production organization of modern competitive products and types of service, creation of new workplaces and ensuring growth of the income of the population:

1. Specify to heads of the State committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition, the Ministry of Health, the Ministry of national education, the Ministry of cases of culture and sport of the Republic of Uzbekistan, their territorial subdivisions, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, the cities and areas their unsatisfactory work and the irresponsible relation to ensuring safety, proper current maintenance and effective use of the buildings and constructions which are on their balance, other objects of state-owned property.

not used objects of state-owned property, including incomplete construction, the investment obligations which are subject to realization in 2014 on competitive basis on "zero" redemption value with condition of acceptance and creation of new workplaces, according to appendix No. 3;

the parcels of land on which the organization of small industrial zones, with the subsequent provision of the parcels of land the size on average on 0,2-0,3 of hectare to subjects of entrepreneurship for the organization on them new productions, objects of service industry and service according to appendix No. 4 is provided;

the objects of state-owned property brought in authorized capital of business entities, and also transferred to other organizations to operational management and free use for further effective use according to appendix No. 5.

4. To the state committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition together with the ministries, departments, joint stock companies, associations, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent in ten-day time to approve schedules of carrying out:

demolition of the objects of state-owned property specified in appendix No. 1, and transfer of the released parcels of land to reserve fund of public authorities on places;

estimates and exposure to the public biddings of not used objects of state-owned property and the companies included in appendix No. 2;

tenders on realization of objects of state-owned property on "zero" redemption value with condition of adoption of investment obligations and creations of new workplaces according to appendix No. 3.

Confer the personal responsibility on heads of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent, the State committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition for ensuring timely demolition and exposure to the biddings of the objects of state-owned property included in appendices No. No. 1, 2 and 3.

5. To the ministries, departments, joint stock companies, associations, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent, organizations and companies asset holders of objects of state-owned property:

in two-month time to provide preparation of cadastral documentation on the parcels of land, buildings and constructions, and also state registration of the rights to them on the objects of state-owned property specified in appendices No. No. 2 and 3;

in a month to transfer on residual book value the objects of state-owned property specified in appendix No. 5, to relevant organs of the public and economic board, the government on places, having conferred on them responsibility for carrying out necessary recovery work and ensuring their further effective use.

It is strict to warn heads of the ministries and departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent, asset holders of objects of state-owned property about their personal responsibility for safety and the current content of the objects of state-owned property specified in appendices No. 2, 5 and 6, before their transfer to the new owner.

6. To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent:

together with the Ministry of Economics and Gosarkhitektstroy of the Republic of Uzbekistan to make in the Cabinet of Ministers of the Republic of Uzbekistan offers on further use of the released parcels of land as a result of demolition of the objects of state-owned property specified in appendix No. 1 in a month;

together with the Ministry of Economics, the State committee on privatization, demonopolization and development of the competition, Goskomzemgeodezkadastry and Gosarkhitektstroy of the Republic of Uzbekistan in two-month time to develop projects of accommodation of subjects of entrepreneurship in the small industrial zones organized based on the parcels of land specified in appendix No. 4, with leading of all necessary engineering communications and infrastructures;

on developed projects of accommodation of subjects of entrepreneurship in small industrial zones to organize carrying out tenders on provision to subjects of entrepreneurship of the parcels of land on average on 0,2-0,3 of hectare with condition of adoption of investment obligations on creation of new workplaces.

SAC of Uzbekenergo, JSC Uztransgaz to provide to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent at the expense of own means construction of necessary engineering communications and infrastructure according to developed projects of accommodation of subjects of entrepreneurship in small industrial zones.

To the Ministry of Economics, the State committee on privatization, demonopolization and development of the competition, Gosarkhitektstroy, Goskomzemgeodezkadastr, the Ministry of Finance, the Ministry of Justice of the Republic of Uzbekistan in two-month time to develop and approve Regulations on procedure for creation and the organization of activities of small industrial zones.

6-1. Establish procedure according to which:

the privatizations which are not revealed when implementing the state assets in the privatized companies, including personal and real estate, are property of data of the companies (their legal successors), except for objects, not privatizeable according to the Law;

the personal and real estate located in the territory of the company, transferred when implementing privatization to use without the order right is recognized property of this company (his legal successors), except for objects, not privatizeable according to the Law;

limited liability companies can have the joint-stock companies consisting of one shareholder as the single founder.

7. Determine that execution of cadastral documentation on the objects of state-owned property of state-financed organizations realized to subjects of small business and private entrepreneurship based on decisions of the President of the Republic of Uzbekistan and the Cabinet of Ministers of the Republic of Uzbekistan is made by budget funds of the Republic of Karakalpakstan and the corresponding local budgets.

8. Extend until the end of 2015 the term of realization of the state assets specified in the Resolution of the President of the Republic of Uzbekistan of April 25, 2012 to No. PP-1743 "About the Privatization program of state-owned property for 2012-2013".

9. Enter since July 1, 2014 the additional regulations and measures directed to simplification of procedure for privatization of objects of state-owned property according to appendix No. 6.

10. To the state committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition together with the Ministry of Justice and other interested ministries and departments to make in the Cabinet of Ministers offers on the changes and amendments in the legislation following from this resolution in a month.

11. To impose control of execution of this resolution on the Prime Minister of the Republic of Uzbekistan Sh. M. Mirziyoev.
