Chapter 1. General provisions

1. These rules of appointment and return of lump money payment in connection with adoption of the orphan child and (or) child, without parental support (further - Rules), are developed according to Item 2 of article 86 of the Code of the Republic of Kazakhstan "About scrap (matrimony) and family" and determine procedure for appointment and return of lump money payment in case of adoption of the orphan child and (or) child, without parental support.

2. Appointment and payment are made by departments of education of the cities of republican value and the capital, departments of formation of areas, cities of regional value (further - department) through the "elektronnoye pravitelstvo" web portal.

Chapter 2. Procedure for purpose of lump money payment in connection with adoption of the orphan child and (or) child, without parental support

4. Lump money payment is appointed and paid to one of adoptive parents if the judgment about adoption of the child took legal effect not earlier than January 1, 2015, and can be realized within twelve months from the date of the introduction in legal force of the above-stated judgment.

Chapter 3. Return of the money paid in the form of lump money payment in connection with adoption of the orphan child and (or) child, without parental support

13. Lump money payment in case of cancellation of adoption or recognition of adoption to invalid is subject to return by the adoptive father to the local budget of the Republic of Kazakhstan within a month from the moment of the introduction in legal force of the judgment about cancellation of adoption or about adoption recognition by invalid.

14. The body within five working days from the date of the introduction of the judgment about cancellation of adoption or recognition of adoption by invalid informs the adoptive father on need of return of the listed lump money payment.

15. In case of not return by the adoptive father of lump money payment at the scheduled time their return is performed judicially.
