According to article 21 of the Law of the Republic of Kazakhstan of March 7, 2014 "About rehabilitation and bankruptcy" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of submission by the administrator of the current and required information on the course of implementation of the rehabilitation procedure or insolvency proceeding.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of submission by the administrator of the current and required information on the course of implementation of the rehabilitation procedure and insolvency proceeding

1. General provisions

1. These rules of submission by the administrator of the current and required information on the course of implementation of the rehabilitation procedure and insolvency proceeding (further - Rules) are developed according to article 21 of the Law of the Republic of Kazakhstan of March 7, 2014 "About rehabilitation and bankruptcy".

2. Rules determine procedure, forms and terms of submission by the administrator to authorized body in the field of rehabilitation and bankruptcy (further - authorized body) the current and required information on the course of implementation of the rehabilitation procedure or insolvency proceeding.

2. Procedure for submission of the current information by the administrator to authorized body

3. The administrator represents to authorized body monthly no later than the 5th following for reporting, the current information on the course of implementation of the rehabilitation procedure for form according to appendix 1 to these rules, or insolvency proceedings in form according to appendix 2 to these rules (further - the current information).

The administrator provides the current information with application of copies of the documents confirming the data specified in the current information.

Submission of the supporting documents sent earlier to authorized body is not required. Supporting documents are submitted according to the data which are again introduced in the current information.

4. The current information consists of the form and appendices to it intended for detailed reflection of information.

5. The current information provided by the administrator on paper is signed personally by the administrator and certified by seal the debtor (in case of its availability).

6. The current information provided by the administrator on the electronic medium is certified by the digital signature of the debtor registered as the electronic taxpayer according to the tax legislation of the Republic of Kazakhstan.

7. Date of provision by the administrator of the current information depending on method of its provision is date:

1) acceptance of the current information by authorized body in attendance procedure;

2) marks about acceptance of the current information of mail or other organization of communication by mail the registered mail with the notification;

3) receipts of the notification on adoption of the current information system of acceptance of the reporting of authorized body in case of provision of the current information in electronic form.

8. The form of the current information is posted on the website of authorized body.

3. Procedure, form and terms of submission of required information by the administrator

Based on request of authorized body the administrator no later than ten working days from the date of receipt of request represents to authorized body the explanation according to required information on the course of implementation of the rehabilitation procedure or insolvency proceeding on form, according to appendix 3 to these rules (further - the explanation), except as specified, when longer completion date is specified in the request.

10. Date of submission of the explanation by the administrator depending on method of its provision is date:

1) acceptance of the explanation by authorized body in attendance procedure;

2) marks about acceptance of the explanation of mail or other organization of communication by mail the registered mail with the notification;

3) deliveries of the explanation to the e-mail address of authorized body in electronic form.

11. The explanation is signed personally by the administrator and certified by seal the debtor (in case of its availability).
