Regulations on permanent representatives of state members of the Shanghai Cooperation Organization under the Secretariat of the Shanghai Cooperation Organization

This Provision determines functions, powers, privileges and immunities of permanent representatives of state members of the Shanghai Cooperation Organization under the Secretariat of the Shanghai Cooperation Organization, stipulated in Article 18 Charters of the Shanghai Cooperation Organization of June 7, 2002.

1. General provisions

1.1. Terms in this Provision mean:

1.1.1. SCO - the Shanghai Cooperation Organization acting on the basis Charters of the Shanghai Cooperation Organization of June 7, 2002.

1.1.2. "State member" - state member of SCO.

1.1.3. "The executive secretary" - the Executive secretary of SCO.

1.1.4. "Secretariat" - the Secretariat of SCO.

1.1.5. "Representatives" are permanent representatives of state members of SCO under the Secretariat.

1.1.6. "Guides of the state" - state members which direct the representatives to the Secretariat.

1.1.7. "Host state" - state member in the territory of which the permanent location of the Secretariat is determined.

2. Functions and powers

2.1. Representatives to the Secretariat are appointed by the directing states according to the existing interstate rules and procedures from among persons having the senior diplomatic positions and start execution of the obligations from the moment of receipt by the Executive secretary of the written notice of their appointment.

Powers of representatives stop from the date of the formal notice of the Executive secretary the directing states about their response.

2.2. Representatives:

2.2.1. Provide representation and interests of the directing states for the purpose of implementation of the principles and tasks of SCO.

2.2.2. Participate in the preparation performed by the Secretariat, examination and approval of the draft documents introduced on meetings of bodies of SCO including in forming of drafts of agendas of meetings of bodies of SCO.

2.2.3. Participate in the organization of accomplishment of decisions of bodies of SCO.

2.2.4. Inform the directing states on activities of the Secretariat of SCO.

2.2.5. Assist the Secretariat in creation of bank of information on the directing states, activities of SCO, necessary for providing.

2.2.6. Render the Secretariat necessary assistance in the questions connected with ensuring timely financing of SCO and Secretariat on the basis of the existing decisions of Council of heads of states and Council of Heads of Government (Prime Ministers) of state members of SCO.

2.2.7. Accept requests of the Secretariat to the directing states about the most important events of internal political life, foreign policy and regional security and promote provision of such information.

2.2.8. Render to the Executive Secretary and his deputies assistance in contacts with the interested ministries and departments of the directing states, according to the practice operating in such states.

3. Privileges and immunities

3.1. Representatives of state members use the privileges and immunities provided to diplomatic agents according to the Vienna convention on the diplomatic intercourses of 1961.

3.2. The members of families (the husband, the wife, children up to 18 years) living together with representatives of state members use the privileges and immunities similar to privileges and immunities of members of families of diplomatic representatives.

4. Other provisions

4.1. Representatives to the Secretariat are part of diplomatic staff of embassies of state members in People's Republic of China.

4.2. The directing states incur all expenses connected with stay and activities of the representatives to the Secretariat.

5. Final provisions

This Provision becomes effective from the date of its approval of state members of SCO by Council of Chapters.

According to the decision of Council of Chapters of state members of SCO changes and/or additions can be made to this Provision.

The relevant decision becomes effective from the date of its signing.
