1. This Provision establishes procedure for provision of the parcels of land in lease for the purpose of connected with placement of the objects of federal importance included in the list of the objects of federal importance which are subject to placement on attached to the subject of the Russian Federation - to the federal city of Moscow the territories (further - object of federal importance).
2. The statement for provision of the parcel of land in lease for the purpose of placement of object of federal importance (further - the application) is submitted by the interested person (further - the applicant) to the executive body (further - the lessor) performing the order the corresponding parcel of land according to part 1 of Article 3 and part 4 of article 15 of the Federal law "About Features of Regulation of Separate Legal Relationship in connection with Accession to the Subject of the Russian Federation — to the Federal City of Moscow of the Territories and about Modification of Separate Legal Acts of the Russian Federation".
3. Are specified in the statement:
a) surname, name, middle name (the last - in the presence) the applicant - the individual entrepreneur or the name of the applicant - the legal entity;
b) surname, name, middle name (the last - in the presence) the representative of the applicant and the basis of its powers;
c) the address, e-mail and phone number for communication with the applicant;
d) one of the bases for provision of the parcel of land in lease for the purpose of connected with placement of object of federal importance, specified in part 7 of article 15 of the Federal law "About Features of Regulation of Separate Legal Relationship in connection with Accession to the Subject of the Russian Federation — to the Federal City of Moscow of the Territories and about Modification of Separate Legal Acts of the Russian Federation";
e) cadastral number of the asked parcel of land (if the parcel of land is formed);
e) specifying on details of the approved documentation on the layout of the territory according to which the parcel of land shall be formed (if the parcel of land is not formed and the corresponding documentation is approved);
g) the term of the lease agreement of the parcel of land, but no more deadline determined by the legislation of the Russian Federation.
4. Copies of documents, the confirming power of the person specified in the subitem "b" of Item 3 this provision and also the statement from the Single state real estate register about real estate object concerning the asked parcel of land are enclosed to the application (if the parcel of land is formed).
5. If the asked parcel of land has to be formed, purpose of object of federal importance, the expected place of its placement, reasons for the approximate size of the parcel of land are specified in the statement. In this case it is required to enclose the feasibility statement on the construction project or necessary calculations to the application.
6. The decision on provision of the parcel of land in lease is made by the lessor within 20 days from the date of receipt of the statement from the applicant. In case of need withdrawals of real estate units and (or) statements of the parcel of land on the state cadastral registration decision making term about provision of the parcel of land is prolonged respectively for the term of withdrawal of such real estate units and (or) the statements on the state cadastral registration of the parcel of land which is subject to provision for the purpose of connected with placement of object of federal importance.
The notification on prolongation of term of decision making on provision of the parcel of land goes the lessor to the applicant to 3-day time from the date of adoption of the relevant decision.
7. In case of need statements of the parcel of land the approved scheme of arrangement of the parcel of land then the applicant provides carrying out cadastral works goes for the state cadastral registration to the applicant in the terms specified in part 5 of article 15 of the Federal law "About Features of Regulation of Separate Legal Relationship in connection with Accession to the Subject of the Russian Federation — to the Federal City of Moscow of the Territories and about Modification of Separate Legal Acts of the Russian Federation" and addresses in the federal executive body authorized by the Government of the Russian Federation on implementation of the state cadastral registration, state registration of the rights, maintaining the Single state real estate register and provision of the data containing in the Single state real estate register, its territorial authorities or state budgetary institution subordinated to it given appropriate authority according to the decision of such body, for the purpose of statement of the parcel of land on the state cadastral registration according to the procedure, established by the Federal Law "About state registration of the real estate.
8. The decision on refusal in provision of the parcel of land in lease is made if:
a) the application is submitted with violation of requirements, stipulated in Item 3 this provision;
b) the formed parcel of land does not conform to requirements to the formed parcels of land established by the legislation of the Russian Federation.
