About approval of the Procedure for delivery of health care to the suffering from tuberculosis persons detained or the punishments containing in organizations of execution

According to part one of article 18 of the Law of Ukraine "About counteraction to disease of tuberculosis" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for delivery of health care to the suffering from tuberculosis persons detained or the punishments containing in organizations of execution which is applied.

Procedure for delivery of health care to the suffering from tuberculosis persons detained or the punishments containing in organizations of execution

1. This Procedure determines the procedure of the organization of obligatory routine medical examination, inspection and treatment of the suffering from tuberculosis persons detained, or containing in organizations of execution of punishments, healthcare institutions of the Public criminal and executive service (further - departmental healthcare institutions of health) and TB facilities in administrative and territorial units in the territory of which the relevant organizations of execution of punishments and pre-trial detention centers of the Public criminal and executive service are located (further - TB facilities).

2. In this Procedure terms are used in the value given in Bases of the legislation of Ukraine on health care, the Laws of Ukraine "About counteraction to disease of tuberculosis", "About pre-trial detention", "About the Public criminal and executive service of Ukraine", "About National guard of Ukraine" and "About National police".

3. The list of TB facilities for delivery of health care to the suffering from tuberculosis persons detained, or the punishments containing in organizations of execution, is determined by the Ministry of Health of the Autonomous Republic of Crimea, structural divisions concerning health care of the regional, Kiev and Sevastopol city state administrations and Public institution "Center of health protection of the Public criminal and executive service of Ukraine".

4. Obligatory routine medical examinations on detection of tuberculosis at the persons detained, or containing in organizations of execution of punishments (except the case specified in the paragraph the second this Item), are carried out in organizations of execution of punishments and pre-trial detention centers of the Public criminal and executive service (further - organizations of execution of punishments and pre-trial detention centers).

Performing obligatory routine medical examinations on detection of tuberculosis at persons condemned to restriction or imprisonment serves sentence in corrective labor colonies of the minimum level of safety with the facilitated conditions of keeping, is provided with TB facilities.

The procedure for performing obligatory routine medical examinations on detection of tuberculosis at the persons detained, or containing in organizations of execution of punishments is determined by regulatory legal acts of the Ministry of Health and Ministry of Justice.

5. The patients with infectious forms of tuberculosis of person detained receive medical care in stationary conditions in sites of pre-trial detention centers of specialized tubercular hospitals of the Public criminal and executive service (further - departmental tubercular hospitals).

In administrative and territorial units in the territory of which there are no departmental tubercular hospitals the suffering from tuberculosis persons detained receive medical care in stationary conditions in TB facilities.

The sick noncontagious forms of tuberculosis of person detained receive medical care in out-patient conditions in the departmental healthcare institutions located in the territory of pre-trial detention centers.

To the suffering from tuberculosis persons condemned to imprisonment for certain term, lifelong imprisonment or arrest, medical care is provided in departmental tubercular hospitals.

In some cases, it is provided to the suffering from tuberculosis persons condemned to imprisonment for certain term, lifelong imprisonment or the arrest determined by the Ministry of Health and Ministry of Justice, medical care in the conditions of hospital in TB facilities.

Medical care is provided to the suffering from tuberculosis persons condemned to restriction of freedom in TB facilities in accordance with general practice.

6. Requirements to arrangement of sites of pre-trial detention centers in departmental tubercular hospitals, special rooms in arestny houses and special chambers in TB facilities for the purpose of ensuring isolation and protection of the suffering from tuberculosis persons detained, condemned to imprisonment for certain term, lifelong imprisonment or arrest are determined by Ministry of Justice, and requirements to their material equipment affirm MZ.

7. The procedure for the direction of the suffering from tuberculosis persons detained, or containing in organizations of execution of punishments, or their biological material in TB facilities including for carrying out necessary inspections (microbiological, radiological, etc.) which cannot be carried out in departmental organizations of health, is determined by the Ministry of Health and Ministry of Justice.

8. Transportations (convoy) of the suffering from tuberculosis persons detained, or containing in organizations of execution of punishments it is performed with use of special transport and observance of requirements of infectious control.

Personnel of the Public criminal and executive service (further - personnel), police officers, military personnel of National guard, and also the suffering from tuberculosis persons detained, condemned to imprisonment for certain term, lifelong imprisonment or arrest, during transportation (convoy) are provided with remedies of respiratory organs, namely patients - masks, personnel and police officers, the military personnel of National guard - respirators.

9. Protection and observation of the suffering from tuberculosis persons detained, condemned to imprisonment for certain term, lifelong imprisonment or arrest during inspection and treatment in special chambers in TB facilities are provided with personnel in certain rooms for protection with observance of requirements of infectious control.

10. External control of quality of work of laboratories which carry out microbiological diagnosis of tuberculosis in departmental tubercular hospitals is performed annually the Ministry of Health.
