According to part two of article 7 of the Law of Ukraine "About providing the rights and freedoms of citizens and legal regime in temporarily occupied territory of Ukraine" and Item 14-4 of the Section XV "Final provisions" of the Law of Ukraine "About obligatory national pension insurance" the Cabinet of Ministers of Ukraine decides:

Approve the Payment procedure of pension and provision of social services to citizens of Ukraine who live in the territory of the Autonomous Republic of Crimea and Sevastopol which is applied.

Payment procedure of pension and provision of social services to citizens of Ukraine who live in the territory of the Autonomous Republic of Crimea and Sevastopol

1. This Procedure determines the payment mechanism of pension and provision of social services to citizens of Ukraine who live in the territory of the Autonomous Republic of Crimea and Sevastopol and do not receive pensions and social services from the Pension Fund of the Russian Federation or other ministries and departments performing provision of pensions in the Russian Federation (further - persons).

2. Provision of pensions of persons receiving pension according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" (except the military personnel of conscription service and members of their families) or according to international treaties of Ukraine on provision of pensions which consent to be bound is provided by the Verkhovna Rada of Ukraine and provisions to such persons of social services are performed by the head departments of the Pension fund of Ukraine determined by the Pension fund of Ukraine, and persons who receive pension according to other legal acts, - managements of the Pension fund of Ukraine in areas, the cities, areas in the cities, and also in the cities and areas (further - territorial authorities).

3. Persons submit to territorial authority the application for receipt of pension according to the legislation of Ukraine with indication of the residence (registration) and the passport of the citizen of Ukraine (the passport of the citizen of Ukraine for trip abroad).

At the request of person, the specified documents can be submitted by his representative who shows the document proving his identity and submits the document (the notarized copy) confirming its powers or are sent by mail. Authenticity of the signature on the statement is certified of such cases notarially.

4. The territorial authority based on the submitted documents sends inquiry for reclamation of pension case to bodies of the Russian Federation, 1 this Procedure specified in Item.

Pension payment after receipt of pension case together with documents on the termination of pension payment is resumed from the date of the termination of payment for the place of preliminary receipt of pension.

5. The procedure for the request of persons for appointment (recalculation), renewal of pension payment to persons, the translation from one type of pension on another, provision of social services, and also confirmation of the fact of non receipt of pension and social services from the bodies of the Russian Federation specified in Item of 1 this Procedure affirms board of the Pension fund of Ukraine in coordination with Minsotspolitiki.

6. Pension payment, provision of social services are performed by monthly postal orders, including international, at the place of residence in the territory of the Autonomous Republic of Crimea and Sevastopol.

At the request of person pension payment, provisions of social services can be performed according to the Payment procedure of pensions and the monetary assistance in the consent of pensioners and receivers of the help through their current accounts in banks, the Cabinet of Ministers of Ukraine approved by the resolution of August 30, 1999 No. 1596 (The Official Bulletin of Ukraine, 1999, No. 35, the Art. 1803), on condition of opening of the bank account, located outside temporarily occupied territory with which the territorial authority signs the relevant agreement.

Transfer of pension to persons is made on condition of representation annually till December 31 to territorial authority of the document on the certificate of the fact that the physical person is live, or passports of the citizen of Ukraine (the passport of the citizen of Ukraine for trip abroad).

In case of non-presentation of the specified documents pension payment stops since January 1 of the next year and is resumed after their representation.

7. Pension payment to persons receiving pension according to international treaties of Ukraine on provision of pensions which consent to be bound is provided by the Verkhovna Rada of Ukraine is performed by territorial authority based on the sheets on pension payment which arrived from the Pension fund of Ukraine.

8. Expenses on payment and delivery of pension, provisions of social services it is performed at the expense of means, stipulated by the legislation on the specified purposes, and in case of insufficiency of such means - at the expense of the means of the government budget provided to the Pension fund of Ukraine for covering of deficit of fund for pension payment.
