Rules of certification of the experts involved by the bodies authorized on implementation of the state control (supervision), bodies of municipal control to holding actions for control according to the Federal Law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control"

I. General provisions

1. These rules establish procedure for certification of the experts involved by the bodies authorized on implementation of the state control (supervision), bodies of municipal control to holding actions for control according to the Federal Law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" (further respectively - certification of experts).

2. Certification of experts is performed by the federal executive bodies, State Atomic Energy Corporation "Rosatom", executive bodies of subjects of the Russian Federation authorized on carrying out the corresponding type of the state control (supervision), bodies of municipal control (further - control facilities (supervision).

Certification of experts is carried out concerning the citizens who are not individual entrepreneurs for confirmation of availability at them special knowledge, experience in certain sphere of science, the equipment and economic activity for the purpose of their attraction (supervision) by control facilities to carrying out stipulated in Item 1 these rules of actions for control.

II. Procedure for certification of experts

3. The citizen applying for receipt of certification of the expert (further - the applicant), submits the following documents to control facility (supervision):

a) the statement for certification for the form established by control facility (supervision) in which are specified:

surname, name and middle name (if is available) the applicant;

residential address of the applicant;

data of the identity document of the applicant;

phone number and the e-mail address (if is available) the applicant;

identification taxpayer number of the applicant;

the area of examination declared according to the list of types of examinations approved by control facility (supervision) for which conducting the control facility (supervision) needs involvement of experts;

type of the state control (supervision) or municipal control;

b) copies of the documents confirming compliance to criteria of certification of experts, stipulated in Item 4 these rules taking into account the list of types of examinations for which carrying out the control facility (supervision) needs involvement of experts.

4. Criteria of certification are established by control facility (supervision) and shall contain requirements to education, length of service, availability of knowledge and skills in certain sphere of science, the equipment, economic activity, including to availability of special professional skills, and knowledge of the legislation of the Russian Federation in the respective sphere.

5. The statement for certification and copies of documents attached to it are represented by the applicant directly or go to control facility (supervision) by the registered mail with the assurance of receipt or in the form of the electronic document signed by the simple digital signature through information and telecommunication networks of general access, including the Internet (further - Internet network), including by means of the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the Single portal).

In case of non-compliance by the applicant with the established application form about certifications or non-presentations of copies of the documents provided by the subitem "b" of Item 3 of these rules, control facility (supervision) within 5 working days from the date of receipt of the specified documents and returns applications them without consideration to the applicant by means of the registered mail with the assurance of receipt or in the form of the electronic document signed by the simple digital signature through information and telecommunication networks of general access, including Internet network, including by means of the Single portal.

7. Check of compliance of the applicant to criteria of certification is performed by verification of the submitted documents and data and holding qualification examination.

8. The control facility (supervision) performs the documents and data submitted by the applicant in time, not exceeding 15 working days from the date of receipt of the statement for certification.

9. By results of verification of the documents and data submitted by the applicant the control facility (supervision) accepts one of the following decisions:

a) about refusal in certification of the applicant - in case of discrepancy of the documents submitted by the applicant to requirements of Item 3 of these rules and (or) discrepancy of the applicant to criteria of certification;

b) about the admission of the applicant to holding qualification examination.

10. The control facility (supervision) notifies the applicant on the made decision specified in Item 9 of these rules within 5 working days from the date of adoption of such decision by means of the registered mail with the assurance of receipt or in the form of the electronic document signed by the simple digital signature through information and telecommunication networks of general access, including Internet network, including by means of the Single portal.

11. Date of qualification examination is established no later than 3 months from the date of receipt of the statement for certification.
