1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) official publication of this order in mass media after its state registration in the Ministry of Justice of the Republic of Kazakhstan;

3) publication of this order on official Internet resource of the Ministry of Emergency Situations of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-Minister of Emergency Situations of the Republic of Kazakhstan Petrov V. V.

4. This Order becomes effective after ten calendar days after day of its first official publication.

Rules of registration and removal from accounting of protective constructions of civil defense

Chapter 1. General provisions

1. These rules of registration and removal from accounting of protective constructions of civil defense (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About civil protection" and determine procedure for registration and removal from accounting of protective constructions of civil defense.

1-1. According to the scheme of placement, protective constructions of civil defense are created only for protection of the greatest working change of state body, the organizations referred to categories on civil defense and also for protection of the nontransportable sick medical organizations.

1-2. Protective constructions of civil defense are used for needs of objects of economy and servicing of the population and stipulated in Item 19 Amounts and contents of the technical actions of civil defense approved by the order of the Minister of Internal Affairs of the Republic of Kazakhstan of October 24, 2014 No. 732 "About the approval of amount and content of technical actions of civil defense" covered in terms contain in the condition providing their reduction in the working condition for acceptance (it is registered in the Register of state registration of regulatory legal acts No. 9922).

Chapter 2. Procedure for registration of protective constructions of civil defense

2. Registration of protective constructions of civil defense is conducted by territorial subdivisions of authorized body in the field of civil protection, state bodies, and also the organizations having protective constructions on balance.

The state bodies and the organizations having on balance protective constructions of civil defense annually till December 1 of the corresponding year provide information on condition of protective constructions in territorial subdivisions of authorized body.

2-1. The list of protective constructions of civil defense is kept by territorial subdivisions of authorized body in the field of civil protection in form according to appendix 1 to these rules.

Adjustment of the List of protective constructions of civil defense is performed annually as of January 1 of the corresponding year.

3. The documentary basis for accounting of protective constructions of civil defense is the passport of shelter (the antiradiation shelter) and the cadastral passport of real estate object.

4. Passports of protective constructions of civil defense are drawn up after input of protective constructions in operation or following the results of inventory count of protective constructions of civil defense.

4-1. Inventory count of protective constructions of civil defense is carried out by territorial subdivisions of authorized body in the field of civil protection together with local executive bodies at least once in 3 (three) years.

Within inventory count comprehensive examination of protective constructions of civil defense is performed.

In case of identification of the protective constructions of civil defense which are not staying on the registry of authorized body by territorial subdivisions in the field of civil protection their registration is performed.

5. In case of absence of the owner or refusal of the owner of the property right to protective construction of civil defense, this object is accepted on accounting as ownerless immovable thing according to Article 242 of the Civil code of the Republic of Kazakhstan.

6. Data on availability of protective constructions of civil defense are represented to authorized body in the field of civil protection.

7. Accession numbers of protective constructions of civil defense are assigned by territorial subdivisions of authorized body in the field of civil protection according to assigned sequence number established in the territory of the corresponding administrative and territorial unit.

Chapter 3. Procedure for removal from accounting of protective constructions of civil defense

8. Protective constructions of civil defense in the following cases are struck off the register:

when losing settlement protective properties of the protecting and bearing building constructions if their recovery is technically impossible or economically inexpedient;

in connection with the new construction, reconstruction, technical retrofitting of buildings and constructions performed according to the decision of state bodies;

in the absence of the organizations to which transfer of protective constructions of civil defense to operational management, municipal services of state body, and the needs for protective constructions of civil defense in this territory for protection of the categories of the population established by the legislation of the Republic of Kazakhstan in the field of civil protection is possible.

9. For the purpose of preparation of documentation for removal from accounting of protective constructions of civil defense the commission is created by the decision:

the head of state body – concerning protective constructions of civil defense of state body;

the head of the organization – concerning protective constructions of civil defense of the organization.
