The convention on the status of the correspondent representing mass media of the State Party of the Commonwealth of Independent States in other states of the Commonwealth

The State Parties of the Commonwealth of Independent States on behalf of the governments which are hereinafter referred to as with the Parties

wishing to promote wide and free dissemination of information on social and political, economic and cultural life of the states,

aiming at respect for the conventional principles and rules of international law, creation of guarantees when implementing professional activity of the correspondents representing mass media of the State Parties of the Commonwealth of Independent States

based on the Agreement on cooperation in the field of information of October 9, 1992,

being effective according to the Charter of the Commonwealth of Independent States providing assistance to broad information exchange agreed as follows:

Article 1

For the purposes of this Convention the following main terms and determinations are used:

the correspondent - the person (irrespective of his nationality) accredited in other State Party of the Commonwealth of Independent States and representing the mass media of one of the Parties registered according to its national legal system;

the state of accreditation - the State Party of the Commonwealth of Independent States in which the correspondent is accredited;

accreditation - appointment to certain term of the representative of mass media to authorized body of the state of accreditation and receipt of the accreditation document by it;

authorized bodies - the central state bodies performing regulation of questions of accreditation and activities of the correspondents representing mass media of other State Parties of the Commonwealth of Independent States.

Article 2

The parties provide optimum conditions for implementation of professional activity to the correspondents representing mass media of the State Parties of the Commonwealth of Independent States, obtaining and distribution by correspondents of the objective information about political, social and economic and cultural life of the state of accreditation.

Article 3

The legal status of the correspondents accredited in the State Parties of the Commonwealth of Independent States is regulated by the conventional principles and rules of international law, international treaties, provisions of this Convention and the legislation of the Parties.

Article 4

Professional activity of the correspondents accredited in the State Parties of the Commonwealth of Independent States is performed according to the legislation of the state of accreditation and the commonly accepted rules and regulations of journalistic ethics.

Article 5

The parties according to the national legal system provide to correspondents, in connection with implementation of professional activity by them, protection of life, honor, advantage and property.

Article 6

When implementing by correspondents of professional obligations of the Party on behalf of authorized bodies according to the national legal system render to correspondents assistance in access to official sources of information, to participation in press conferences and other similar actions on the bases equal to the bases provided to representatives of mass media of the state of accreditation and recognize the right of correspondents to preserving confidentiality of source of information.

Article 7

Correspondents are granted the right of free movement on the territory of the state of accreditation, except for areas and objects for which visit the special procedure is established.

Article 8

The parties observe the right of correspondents to free transfer to mass media which they represent of the materials by the method which is not prohibited by the legislation of the state of accreditation.

Article 9

Requests about accreditation of correspondents and opening of offices of mass media of gosudarstvuchastnik of the Commonwealth of Independent States are considered in time, not exceeding two months from the date of receipt of the written address.

Article 10

In case the visa regime is effective, the Parties according to the national legal system provide to constantly accredited correspondents and members of their families repeated entrance/exit visas or other document granting the right to free entrance to the territory and departure from the territory of the state of accreditation.

Article 11

The parties on behalf of authorized bodies, in case of need, render according to the national legal system assistance to constantly accredited correspondents in lease or acquisition office and premises.

The parties according to the national legal system provide the help to accredited correspondents and members of their families in case of contingencies (natural disaster, accident, etc.).

Article 12

The parties on behalf of authorized bodies will abstain from acceptance of rationing arrangements, including such as deprivation of the correspondent of accreditation or its expulsion from the state of accreditation because of contents of the information transferred to them and distributed by mass media which the correspondent, except as specified represents violations of the legislation of the state of accreditation by it.

Article 13

The questions connected with interpretation and application of provisions of this Convention and also the facts of its violation are considered and permitted by authorized bodies of the Parties by negotiations and consultations.

Article 14

This Convention becomes effective from date of delivery to depositary of the third notification on accomplishment by the Parties of the interstate procedures necessary for its entry into force which signed it.

For the Parties which performed interstate procedures later this Convention becomes effective from date of delivery to depositary of the adequate notice.

Article 15

Changes and additions which are drawn up by the separate protocol which is integral part of this Convention and becoming effective according to the procedure, stipulated in Article the 14th this Convention can be made to this Convention.

Article 16

This Convention is open for accession of the gosudarstvuchastnik of the Commonwealth of Independent States dividing its provisions and ready to assume liabilities following from this Convention. For the joining state the Convention becomes effective from date of delivery to depositary of documents on accession.
