Regulations on the Public registration service of Ukraine

1. The public registration service of Ukraine (Ukrgosreestr) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Justice realizing state policy concerning state registration of acts of civil status, the rights to real estate and their encumbrances, legal entities and physical persons - entrepreneurs, agreements of commercial concession (subconcession), registration (legalization) of associations of citizens, the public unions, other public forming, charters of funds of obligatory national social insurance if their registration is provided by the laws, the charter of territorial community of Kiev, state registration of printing mass media and news agencies as subjects of information activities.

2. Ukrgosreestr in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives to Ukrgosreestr are:

1) realization of state policy concerning state registration of acts of civil status, the rights to real estate and their encumbrances, legal entities and physical persons - entrepreneurs, agreements of commercial concession (subconcession), registration (legalization) of associations of citizens, the public unions, other public forming, charters of funds of obligatory national social insurance if their registration is provided by the laws, the charter of territorial community of Kiev, state registration of printing mass media and news agencies as subjects of information activities;

2) submitting for examination of the Minister of Justice of offers on ensuring forming of state policy in the specified spheres.

4. Ukrgosreestr compliance with the tasks assigned to it:

1) generalizes practice of application of the legislation on the questions which are within its competence develops suggestions for improvement of legal acts, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, regulatory legal acts of the ministries and in accordance with the established procedure represents them to the Minister of Justice;

Coordinates 2) and controls activities in spheres of state registration of acts of civil status, the rights to real estate and their encumbrances, legal entities and physical persons - entrepreneurs, agreements of commercial concession (subconcession), registration (legalization) of associations of citizens, the public unions, other public forming, charters of funds of obligatory national social insurance if their registration is provided by the laws, the charter of territorial community of Kiev, state registration of printing mass media and news agencies as subjects of information activities;

3) will organize the work connected with ensuring activities in certain spheres and performs actions for increase in efficiency of such work;

4) exercises the state supervision and/or control of compliance with law in certain fields of activity, takes measures to prevention of violations in these spheres and makes the relevant decisions having obligatory;

5) is performed by methodical and information support of activities of bodies of state registration, bodies of state registration of acts of civil status about carrying out state registration, gives practical and methodical help to consular establishments and diplomatic representations of Ukraine abroad on state registration of acts of civil status;

6) is performed by methodical and information support of activities of notaries for carrying out state registration of the rights to real estate and their encumbrances in coordination with Ministry of Justice;

7) is provided by accomplishment of international treaties on legal assistance and legal relations on civil and family cases which consent to be bound is provided by the Verkhovna Rada of Ukraine, regarding reclamation abroad of documents on civil registration and executions of requests about rendering legal assistance on the questions which are within the competence of bodies of state registration of acts of civil status and also representation within the powers provided by the law, other documents concerning personal or property rights and interests of physical persons or legal entities;

8) provides administrative service in putting down of apostille on the official documents issued by Ukrgosreestr and structural divisions of head departments of justice of Ministry of Justice in the Autonomous Republic of Crimea in areas, Kiev and Sevastopol, and also district, district in the cities, city (the cities of regional value), interdistrict justice departments which provide implementation of powers to Ukrgosreestr;

9) performs state registration of the rights to real estate;

10) is provided by access to courts of law to data of the Unified State Register of Legal Entities and physical persons - entrepreneurs;

11) provides special verification of the data on availability of persons applying for holding the posts, connected with accomplishment of functions of the state or local self-government, corporate laws;

12) is issued by specialized printing mass media in which data from the Unified State Register of Legal Entities and physical persons - entrepreneurs are published;

13) is provided on the official website by access to data from the Unified State Register of Legal Entities and physical persons - entrepreneurs;

14) provides state bodies of information from the Unified State Register of Legal Entities and physical persons - entrepreneurs according to the procedure, established by Ministry of Justice;
