RESOLUTION OF THE MINISTRY OF HEALTH OF THE REPUBLIC OF BELARUS

About approval of Sanitary standards and the rules "Requirements to Ensuring Radiation Safety of Personnel and the Population when Implementing Activities for Use of Atomic Energy and Sources of Ionizing Radiation" and entering of amendment into the resolution of the Ministry of Health of the Republic of Belarus of December 28, 2012 No. 213

Based on article 13 of the Law of the Republic of Belarus of January 7, 2012 "About sanitary and epidemiologic wellbeing of the population", paragraph two of subitem 8.32 of Item 8 of the Regulations on the Ministry of Health of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 28, 2011 No. 1446 "About some questions of the Ministry of Health and measures for implementation of the Presidential decree of the Republic of Belarus of August 11, 2011 No. 360" the Ministry of Health of the Republic of Belarus DECIDES:

1. Approve the enclosed Sanitary standards and the rules "Requirements to Ensuring Radiation Safety of Personnel and the Population when Implementing Activities for Use of Atomic Energy and Sources of Ionizing Radiation".

2. Add Item 1 of the Sanitary standards and the rules "Requirements to Radiation Safety" approved by the resolution of the Ministry of Health of the Republic of Belarus of December 28, 2012 No. 213 "About approval of Sanitary standards and the rules "Requirements to Radiation Safety" and the Hygienic standard rate "Criteria for evaluation of radiative effects" (The national legal Internet portal of the Republic of Belarus, 25.05.2013, 8/26850), part of the following content:

"Additional requirements can be established by technical regulatory legal acts of the Republic of Belarus to:

radiation safety of personnel and the population when implementing activities for use of atomic energy and sources of ionizing radiation;

radiation safety of personnel and the population in case of the treatment of radioactive waste;

radiation safety of personnel and the population when implementing other types of practical activities.".

3. This resolution becomes effective since March 1, 2014.

Sanitary standards and rules "Requirements to Ensuring Radiation Safety of Personnel and the Population when Implementing Activities for Use of Atomic Energy and Sources of Ionizing Radiation"

Chapter 1 General provisions

1. These Sanitary standards and rules establish requirements to ensuring radiation safety of personnel and the population when implementing activities for use of atomic energy and sources of ionizing radiation.

2. These Sanitary standards and rules are obligatory for observance by state bodies, other organizations, physical persons, including individual entrepreneurs.

Sanitary standards and rules extend to all users of sources of ionizing radiation (further - III) (including subjects to use of atomic energy) during the designing, construction, operation, reconstruction, including upgrade, capital repairs in case of which expansion or increase in capacity, and also change of purpose of objects of social, production, transport, engineering infrastructures and conclusion from operation of radiation objects are performed, and also in case of storage of III, except for users of III, designing, construction and which reconstruction began before entry into force of these Sanitary standards and rules (regarding designing, reconstruction and construction).

3. The state sanitary inspection behind respect for these Sanitary standards and rules is performed according to the legislation of the Republic of Belarus.

4. Perpetrators bear responsibility according to legal acts of the Republic of Belarus for violation of these Sanitary standards and rules.

5. For the purposes of these Sanitary standards and rules the main terms and their determinations in the values established by the Law of the Republic of Belarus of January 5, 1998 "About radiation safety of the population" are used (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus 1998, No. 5, the Art. 25), the Law of the Republic of Belarus of July 30, 2008 "About use of atomic energy" (The national register of legal acts of the Republic of Belarus, 2008, No. 187, 2/1523), the Sanitary standards and the rules "Requirements to Radiation Safety" and the Hygienic standard rate "Criteria for evaluation of radiative effects" approved by the resolution of the Ministry of Health of the Republic of Belarus of December 28, 2012 No. 213 (The national legal Internet portal of the Republic of Belarus, 25.05.2013, 8/26850), and also the following terms and their determinations:

zone of planning of restrictions on food - zone around nuclear installation concerning which the events directed to implementation of the counter-measures (for example, agricultural) interfering oral intake of radionuclides with water and foodstuff of local production, and long-term protective measures for the purpose of prevention of high collective doses of radiation in that degree in what it is almost feasible are held;

zone of planning of urgent protective measures - zone around nuclear installation concerning which the events directed to implementation of urgent protective measures in case of nuclear or radiation emergency for the purpose of prevention of stochastic effects in that degree in what it is almost feasible are held;

zone of preventive measures - zone around nuclear installation concerning which events for implementation of urgent protective measures in case of nuclear or radiation emergency for the purpose of decrease in risk of emergence of the heavy determined effects outside industrial site are held;

the work permit - task for the safe production of work which is drawn up on the special form of the established form and the determining content, place of employment, time of its beginning and the termination, condition of its safe accomplishment, necessary security measures (including on radiation, fire safety and on gas-polluted workplaces), structure of crew and the workers responsible for safe performance of work;

radiation control - receipt of information on radiation situation in the organization, in the environment and about levels of radiation of people (includes radiation and radiometric control);

sanitary propusknik (further - the sanitary inspection room) - complex of the rooms and the equipment intended for change of clothes, footwear, sanitary processing of personnel, control of radioactive pollution of integuments, individual protection equipment, special and personal clothes of personnel;

sanitary lock (further - sanitary lock) - the room intended for preliminary deactivation and change of additional resources of individual protection;

individual protection equipment (further - SIZ) - personnel remedy from external radiation, intake of radioactive materials in organism and radioactive pollution of integuments.

6. III are subject to obligatory registration in single state system of accounting and control III according to the procedure, No. 562 established by the resolution of Council of Ministers of the Republic of Belarus of April 30, 2009 "About approval of the Regulations on procedure for state registration of sources of ionizing radiation and maintaining single state system of accounting and control of sources of ionizing radiation" (The national register of legal acts of the Republic of Belarus, 2009, No. 109, 5/29694).

7. The user of III has the right to work with III, production, use, storage, transportation and burial of radioactive waste, other III, in the presence of the sanitary passport of the right of work with III (further - the sanitary passport) which is drawn up in form according to appendix 1 to these Sanitary standards and rules according to the requirements stated in the annex 2 to these Sanitary standards and rules, and the special permission (license) issued according to the procedure established by the legislation. Availability of the conclusion of bodies of the state sanitary inspection about compliance of works with radioactive materials and other III to health regulations and regulations, hygienic standard rates and other regulatory legal acts is the compulsory provision of approval of works.

Prior to works with III, and also after suspension of work of object by the bodies performing state sanitary inspection of holding actions for elimination of violations of health regulations and regulations, hygienic standard rates, other regulatory legal acts and the solution of question of continuation of works with III the user of III shall receive the sanitary passport.

8. Effective period of the sanitary passport is determined by the organization of state sanitary inspection, but shall not exceed 3 years.

9. Receipt of the sanitary passport in cases is not required if:

9.1. devices, the substances and products which are not subject to obligatory registration in single state system of accounting and control III according to the resolution of Council of Ministers of the Republic of Belarus of April 30, 2009 No. 562 are used;

9.2. on workplace:

specific activity of open radio nuclide sources is less than minimum significant specific activity (further - MZUA) and activity of open radio nuclide source of radiation less minimum significant activity (further - MZA), given in appendix 13 to the Hygienic standard rate "Criteria for evaluation of radiative effects" approved by the resolution of the Ministry of Health of the Republic of Belarus of December 28, 2012 No. 213 (further - the Hygienic standard rate "Criteria for evaluation of radiative effects"), at the same time the amount of the attitudes of activity of separate radionuclides towards their tabular values less than 1;

9.3. in the organization:

general activity of open radio nuclide sources of radiation does not exceed more than by 10 times of MZA or the amount of the attitudes of activity of different radionuclides towards their tabular values given in appendix 13 to the Hygienic standard rate "Criteria for evaluation of radiative effects" does not exceed 1;

9.4. capacity of dose in any point which is at m 0,1 distance from surface of the closed radio nuclide source of radiation does not exceed μSv/h 1,0 over background, and its reliable sealing is provided.

10. In case of the planned export of III for work with it out of the approved works location to which action of the sanitary passport extends, it is necessary to inform (in writing) the organization which issued the sanitary passport, and the organization exercising the state sanitary inspection in the place of the planned work. Execution of the new sanitary passport in the place of the planned work is not required if the organization of the temporary storage warehouse of III is not provided.

Chapter 2 Basic principles of ensuring radiation safety

11. Radiation safety of personnel and the population is considered secure if the basic principles of radiation safety (regulation, reasons, optimization) and the requirements established by the Law of the Republic of Belarus "About radiation safety of the population" are observed.

12. The principle of reasons is applied when designing new sources of radiation and radiation objects, in case of issue of licenses and approval and (or) approval of technical regulatory legal acts on use of sources of radiation, and also in case of change of conditions of their operation. Practical realization of the basic principles of ensuring radiation safety is carried out according to the approaches stated in annex 3 to these Sanitary standards and rules.

In case of radiation accident the principle of reasons is applied not to III and conditions of radiation, and to protective measure. Priority protective measure is recovery of control over III.

The principle of optimization is applied in the conditions of normal operation of III and according to appendix 3 to these Sanitary standards and rules.

In case of radiation accident when instead of limits of doses general criterions of reaction are effective, the principle of optimization shall be applied to protective measure taking into account the predicted dose which can be prevented or reduced by means of preventive urgent protective measures, and the damage connected with holding protective measures.

The principle of regulation is applied for the purpose of not exceeding of the main limits of doses of radiation established by the Law of the Republic of Belarus "About radiation safety of the population" in the territory of the Republic of Belarus of the population and personnel (workers) (further - personnel).

13. For control of effective and equivalent doses of radiation the system of the controlled parameters which are derivative standard rates from boundary doses, set proceeding from not exceeding of limits of doses is entered.

As derivative standard rates in case of technogenic radiation are calculated for one-factor impact and each of them exhausts all limit of dose, their use shall be based on condition of not exceeding of value equal to unit of the amount of the attitudes of all controlled sizes towards their admissible values.

14. For the purpose of radiation protection of the population and observance of the limit of dose of radiation by bodies of state sanitary inspection set for the population quotas (boundary doses) for types of practical activities shall be established.

Establishment of quotas for radiation of the population from separate technogenic III is carried out taking into account the principles stated in annex 4 to these Sanitary standards and rules.

Chapter 3 Assessment of condition of radiation safety

15. Assessment of condition of radiation safety is based on the main indicators, the stipulated in Article 11 Laws of the Republic of Belarus "About radiation safety of the population".

16. The radiation and hygienic passport of the user of III, reflects the level of ensuring radiation safety in the organization. The form of the radiation and hygienic passport of the user of sources of ionizing radiation is approved by the resolution of Council of Ministers of the Republic of Belarus of June 24, 2006 No. 797 "About the radiation and hygienic passport of the user of sources of ionizing radiation, procedure for its maintaining and use and recognition No. 391 which voided resolutions of Council of Ministers of the Republic of Belarus of March 23, 1999" (The national register of legal acts of the Republic of Belarus, 2006, No. 104, 5/22495) (further - the radiation and hygienic passport).

17. For assessment of condition of radiation safety of III the indicator of radiation risk according to Chapter 1 of Sanitary standards and the rules "Requirements to Radiation Safety" is used. The importance of everyone and all III should be estimated on their contribution to total effective dose most of which characterizes radiation risk.

Chapter 4 of the Way of ensuring radiation safety

18. Radiation safety on radiation object and in the adjacent territory is provided for the account:

observance of requirements of regulatory legal acts and technical regulatory legal acts by preparation of the project documentation of radiation object including reasons for the choice of the area and platform for placement of radiation object, level of physical protection of III, zoning of the territory around and in objects I and II of the category established according to Item of 38 presents of Sanitary standards and rules;

observance of service conditions of technology systems;

uses of the products and technologies which passed the state sanitary and hygienic examination on radiation factor which is carried out according to the procedure, the established Regulations on procedure and conditions of conducting the state sanitary and hygienic examination approved by the resolution of the Ministry of Health of the Republic of Belarus of January 3, 2013 No. 1 (The national legal Internet portal of the Republic of Belarus, 02.02. 2013, 8/26857);

organizations and carrying out radiation control;

planning and holding actions for ensuring radiation safety of personnel and the population in case of normal operation of radiation object, its reconstruction and conclusion from operation;

readiness for response to emergencies;

informing and personnel trainings and the populations in the field of ensuring radiation safety;

respect for culture of safety.

19. Radiation safety of personnel is ensured:

restriction of the admission of personnel to work with III on age, sex, the state of health, level of the previous radiation;

knowledge and observance of rules of work with III;

creation of the working conditions conforming to requirements of normative legal and technical regulatory legal acts;

observance of standard rates: main limits of doses of radiation, boundary doses and reference levels;

use of remedies from ionizing radiation, and also protection use in distance and restriction of operating time with III;

organization and carrying out radiation control;

informing on radiation situation;

holding actions for protection of personnel when planning of the increased radiation in case of threat and emergence of accident;

availability of the corresponding qualification.

20. Radiation safety of the population is ensured:

creation of conditions of life activity of the people meeting the requirements established by technical regulatory legal acts in the field of ensuring radiation safety;

establishment of quotas for radiation from different III;

organization of radiation control;

efficiency of planning and holding actions for radiation protection in normal conditions and in case of radiation accident;

organization of system of informing on radiation situation.

21. Radiation safety of personnel and the population from sources of potential radiation is provided with application of technical measures for decrease in probability of events owing to which the values of the generalized boundary risk established in Item 24 of Sanitary standards and the rules "Requirements to Radiation Safety", and also measures for minimization of effects of radiation accident can be exceeded.

22. Radiation safety of the population in the territories where owing to last economic activity or radiation accidents there is residual radioactive pollution or sources of potential radiation, is provided with the measures of protection according to the principle of optimization directed to localization of source, restriction of access and (or) informing the population on factors of radiation hazard.
