The government of Turkmenistan and the Government of the Republic of Uzbekistan which are hereinafter referred to as with the Parties, being guided by provisions of the Treaty of friendship, cooperation and mutual assistance between Turkmenistan and the Republic of Uzbekistan of January 16, 1996, expressing aspiration to further deepening of the relations between two states and development of contacts between citizens of the states, for the purpose of settlement of procedure for crossing of Frontier, streamlining of entrance, departure and stay of citizens in the territory of the states of the Parties, considering that further enhancement of conditions of trips of citizens of two states will serve strengthening of the mode of frontier, maintenance of legality and law and order, agreed as follows:

Article 1

Citizens of the state of one Party can drive, leave, follow en route and stay temporarily in the territory of the state of other Party according to the valid documents listed in appendices No. No. 1 and 2, and on the conditions provided by this agreement.

The questions which are not settled by this agreement will be solved according to the national legal system of the states of the Parties.

Article 2

Citizens of the states of the Parties during stay in the territory of the state of other Party shall follow the laws and rules of the state of this Party, including the rule of registration, stay and movement established for foreign citizens.

Article 3

Citizens of the states of the Parties drive, leave and follow en route through the territory of the state of one of the Parties through check points on frontier with observance of the boundary, customs and other procedures provided by the national legal system of the states of the Parties.

The list of check points is approved by the Parties through diplomatic channels.

Article 4

Citizens of the state of one Party for receipt of a visa of the state of other Party represent to diplomatic representation or consular establishment of this Party the written appeal and the invitation of the relevant legal entity or physical person which is drawn up in accordance with the established procedure, except as specified, specified in this agreement.

Article 5

1. The citizens of Turkmenistan who are owners of the valid diplomatic or service passports, assuming to stay in the territory of the Republic of Uzbekistan no more than thirty days and the citizens of the Republic of Uzbekistan who are owners of the valid diplomatic passports, assuming to stay in the territory of Turkmenistan no more than thirty days will drive, leave and stay in the territory of the state of other Party without visas.

2. If the citizens of the states of the Parties specified in Item 1 of this Article intend to stay in the territory of the state of other Party more than thirty days, receipt of a visa requires the written appeal of diplomatic representation or consular establishment of the state of the Party which citizens they are.

Article 6

1. The citizens of the state of one Party owning the valid diplomatic or service passports and being the staff of the diplomatic representations, consular establishments and international organizations which are in the territory of the state of other Party drive, leave and stay in the territory of the state of other Party without visas during the entire period of work.

2. Provisions of Item 1 of this Article extend also to members of families of the specified citizens who live together with them during official stay and are owners of the valid diplomatic or service passports.

3. Members of administrative technicians of diplomatic representation and consular establishments of the Republic of Uzbekistan in Turkmenistan, and also the members of their families owning the valid national passports of citizens of the Republic of Uzbekistan drive, leave and stay in the territory of Turkmenistan based on the multi-visas which are drawn up without collection of the consular fees.

4. Persons specified in Items 1-3 of this Article shall have the corresponding accreditation of the Ministry of Foreign Affairs of the state of stay.

Article 7

1. The citizens of the Republic of Uzbekistan who are constantly living in the Khorezm and Bukhara regions, and also in areas of the Republic of Karakalpakstan, the Surkhandarya and Kashkadarya regions of the Republic of Uzbekistan (the appendix N 3 to the this Protocol), directly adjacent to frontier of Turkmenistan, being owners of the valid passports of citizens of the Republic of Uzbekistan of new sample and passports of citizens of the Republic of Uzbekistan of old sample can drive, leave and stay without visas in the territory of the Dashoguz and Lebapsky welayats of Turkmenistan no more than three days once a month.

2. The citizens of Turkmenistan who are constantly living in the Dashoguz and Lebapsky welayats of Turkmenistan can drive, leave and stay without visas in the territory of the Khorezm and Bukhara regions, and also in the territory of areas of the Republic of Karakalpakstan, the Surkhandarya and Kashkadarya regions of the Republic of Uzbekistan (the appendix N 3 to the this Protocol), directly adjacent to frontier of Turkmenistan, no more than three days once a month.
