About some questions connected with establishment of monthly pension supplement to persons performing powers of the member of the Federation Council, the deputy of the State Duma of Federal Assembly of the Russian Federation

1. Approve the enclosed Rules of establishment, payment and renewal of payment of monthly pension supplement to persons performing powers of the member of the Federation Council, the deputy of the State Duma of Federal Assembly of the Russian Federation.

2. Recognize invalid:

the order of the Government of the Russian Federation of April 8, 2000 No. 318 "About realization of social guarantees of the members of the Federation Council and deputies of the State Duma of the Russian Federation established by the Federal Law "About the Status of the Member of the Federation Council and the Status of the Deputy of the State Duma of Federal Assembly of the Russian Federation" (The Russian Federation Code, 2000, No. 16, the Art. 1711);

the order of the Government of the Russian Federation of May 16, 2001 No. 378 "About some social guarantees of People's Deputies of RSFSR of convocation of 1990 - 1995 which were members of the Supreme Council of the Russian Federation" (The Russian Federation Code, 2001, No. 21, the Art. 2088);

2. For calculation of the amount of monthly pension supplement to citizens of the Russian Federation the monthly monetary reward is determined (by their choice) on the state position of the Russian Federation replaced in the Federation Council or the State Duma of Federal Assembly of the Russian Federation (further - the Federation Council, the State Duma) on the date of achievement of the age granting the right to the insurance pension on old age provided by the Federal Law "About Insurance Pensions" (granting the right to work old-age pension according to the Federal Law "About Work Pensions in the Russian Federation") by them, or on the last state position of the Russian Federation on which powers were stopped (including ahead of schedule).

3. Monthly pension supplement is established by the decision of the Ministry of Labour and Social Protection of the Russian Federation (further - the Ministry) based on the petition from the citizen of the Russian Federation issued in form according to appendix No. 1 and provided to the Ministry or to the Office of the Federation Council, State Duma administration respectively.

3(1). In case of refusal the citizen of the Russian Federation from monthly pension supplement he submits the declaration of abandonment of monthly pension supplement issued in form according to appendix No. 1(1). The passport copy of the citizen of the Russian Federation is enclosed to the specified application.

The declaration of abandonment of monthly pension supplement is submitted according to the procedure provided for filing of application about establishment of monthly pension supplement (further - the statement).

In case of refusal the citizen of the Russian Federation from the established monthly pension supplement the Ministry sends to the Pension Fund of the Russian Federation the notification for the termination of its payment with application of a copy of the declaration of abandonment of monthly pension supplement.

4. The following documents are enclosed to the application:

a) passport copy of the citizen of the Russian Federation;

b) copy of the service record;

c) the original of the archival certificate of implementation by the People's Deputy of RSFSR of convocation of 1990 - 1995 of deputy activities in the Supreme Council of the Russian Federation or in its bodies on permanent basis or about election as his member of the Supreme Council of the Russian Federation (in case of lack of the corresponding employment records);

d) the copy of the pension certificate or the certificate of provision of pensions from the body performing provision of pensions.

5. The application is submitted by the citizen of the Russian Federation personally, through the legal or authorized representative (further - the representative) or goes by means of mail service.

In case of the personal address the signature of the citizen of the Russian Federation or the representative makes sure the authorized employee of the Ministry or the Office of the Federation Council, State Duma administration respectively. In case of the direction of the statement by means of mail service the signature of the citizen of the Russian Federation or the representative makes sure of notarial procedure.

In case of filing of application through the representative passport copies of the representative and the document confirming it the power which is drawn up according to the procedure, established by the legislation of the Russian Federation are attached to him.
