The Russian Federation and the Republic of Kazakhstan which are hereinafter referred to as with the Parties

being guided by the Declaration between the Russian Federation and the Republic of Kazakhstan on eternal friendship and the alliance oriented in the XXI century of July 6, 1998,

developing regulations of the Agreement between the Russian Federation and the Republic of Kazakhstan on the basic principles and conditions of use of the Baikonur spaceport of March 28, 1994,

agreed as follows:

Article 1

The purpose of this agreement is development of mutually beneficial cooperation of the Parties within joint activities for ensuring further effective use of the Baikonur spaceport for the benefit of the Russian Federation and the Republic of Kazakhstan, program implementation of international cooperation.

Article 2

The parties recognize importance of upgrade of infrastructure of the Baikonur spaceport and preserving its historically significant objects.

The Russian side will promote in every possible way participation of the Kazakhstan Side in projects implementation on creation and use at the Baikonur spaceport of new ecologically safe space-rocket complexes, other joint space projects and programs taking into account requirements of the legislation of the Russian Federation for protection of the state secret.

The Russian and Kazakhstan specialists and the organizations on identical conditions will participate in realization of joint projects at the Baikonur spaceport.

Article 3

The parties recognize need of increase in level of ecological safety of space-rocket activities in the territory of the Republic of Kazakhstan in the way:

upgrades operated and creations of new ecologically safer space-rocket complexes at the Baikonur spaceport for the subsequent step-by-step reducing operation of the carrier rockets using highly toxic components of rocket fuel (amyl, heptyl);

carrying out the joint operations on providing ecological safety and the problem resolution of environmental protection connected with implementation of space-rocket activities.

Article 4

The parties are developed and create at the Baikonur spaceport the space-rocket Bayterek complex with the high level of ecological safety based on the Russian space-rocket Angara complex which flight testing will be carried out by the Russian Side at the Plesetsk spaceport.

Article 5

The governments of the Parties in 2004 will sign the relevant agreements on accomplishment of provisions of Articles 3 and 4 of this agreement, including questions of financing, or will make changes to the relevant international agreements on the Baikonur complex.

Article 6

The lease term is prolonged by the Russian Federation of the Baikonur complex till 2050.

The governments of the Parties will make corresponding changes to the Lease agreement of the Baikonur complex between the Government of the Russian Federation and the Government of the Republic of Kazakhstan of December 10, 1994.

Article 7

Changes and additions on the basis of mutual consent of the Parties can be made to this agreement. Changes and amendments are drawn up by the protocols which are integral parts of this agreement.

Article 8

Disagreements concerning interpretation and application of provisions of this agreement are subject to settlement by consultations and negotiations between the Parties.

Article 9

This agreement is temporarily applied from the date of its signing and becomes effective from the date of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force.

At the initiative of one of the Parties the Agreement it can be terminated not earlier than in 12 months from the moment of the written notice by the concerned party of other Party.

It is made in Astana on January "9", 2004 in duplicate, everyone in the Russian and Kazakh languages, and both texts are equally authoritative.
