About construction of two bridges and sections of the highway

The government of the Kyrgyz Republic and the Government of the Republic of Tajikistan which are referred to as further with the Parties, being guided by the Agreement on bases of the interstate relations between the Kyrgyz Republic and the Republic of Tajikistan of July 12, 1996,

in pursuance of the Protocol of meeting of the Kyrgyz-Tajik Intergovernmental commission on complex consideration of bilateral questions concerning construction of bridges and the highway adjoining to them of December 15, 2012,

in the spirit of neighborliness and mutually beneficial cooperation,

agreed as follows:

Article 1

For the purpose of ensuring free transition of citizens and journey of vehicles of both states, the Parties will perform construction of two bridges via the channel Gulyakandoz and the river Kozubaglan (Hodge-Bakirgon), and also the sections of the highway adjoining to them with the following geographical coordinates:

1) the beginning of sections of the highway - X =442087.940; Y=558323.751;

2) end of sections of the highway - X =441955.514; Y=558105.377.

The detailed sheet of coordinates of elements of curves is attached to this agreement and is its integral part.

Article 2

Expenses on construction of bridges and the sections of the highway adjoining to them, including the expenses connected with possible demolition of buildings, constructions, other structures and grounds will be performed by the Parties in equal shares according to the plan of the route approved by the Parties, the scheme of highways and settlement cost of expected construction. The approved plan of the route, the scheme of highways, estimated cost of expected construction, construction terms according to the production schedule of works, and also procedure for further content of bridges and the sections of the highway adjoining to them are drawn up by separate Protocols authorized bodies of the Parties within one month from signature date of this agreement.

Article 3

Authorized bodies of the Parties on implementation of provisions of this agreement are the Ministry of Transport and Communications of the Kyrgyz Republic and the Ministry of transport of the Republic of Tajikistan.

Article 4

The parties will not refer to provisions of this agreement during delimitation and demarcation of frontier between the Kyrgyz Republic and the Republic of Tajikistan.

Article 5

The parties will not limit to any method journey of vehicles and transition of citizens of both Parties, and also to establish the posts or other constructions limiting their movement on the section of two bridges and the highway which construction is subject of this agreement.

Article 6

The questions connected with determination of the property rights to the built bridges and sections of the highway adjoining to them will be solved after completion of process of delimitation and demarcation of frontier between the Kyrgyz Republic and the Republic of Tajikistan.

Article 7

In case of disputes during implementation of this agreement, the Party will solve them by negotiations and consultations.

Article 8

By mutual consent of the Parties changes and additions which are drawn up by the separate Protocols which are its integral part can be made to this agreement and become effective according to Article 9 of this agreement.

Article 9

This agreement is temporarily applied from signature date and becomes effective from the date of receipt of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force.

Article 10

This agreement will be effective before full completion of process of delimitation and demarcation and legal registration of frontier between the Kyrgyz Republic and the Republic of Tajikistan. It is made in the city of Dushanbe on March 31, 2014, in duplicate, everyone in the Kyrgyz, Tajik and Russian languages, and all texts are equally authoritative. In case of disagreements in interpretation of provisions of this agreement, the Parties will be guided by the text in Russian.
