1. Approve the enclosed Rules of passing of polygraphological research in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of passing of polygraphological research in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan

1. These rules of passing of polygraphological research in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan (further – Rules) determine procedure for passing of polygraphological research by citizens, and also law enforcement officers, bodies of civil protection, the public courier service of the Republic of Kazakhstan.

2. The basic concepts and terms used in these rules:

1) polygraph - the technical device intended for registration in the course of the poll of the person of dynamics of physiological reactions (breath, cardiovascular activity, skin and galvanic reaction, physical activity, facial expression and another) in response to the shown verbal and visual incentives displayed in analog and (or) digital form;

2) polygraphological research - poll procedure consisting in registration by means of special sensors of separate physiological reactions of the person;

3) the polygraphologist - the person who had the corresponding training and having the document (the certificate, the diploma, the certificate) confirming its right to carrying out polygraphological research.

3. The polygraphological research (further – research) is passed:

1) the citizens employed in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan (for study in the organization of formation of law enforcement agencies);

3) law enforcement officers, bodies of civil protection, public courier service of the Republic of Kazakhstan:

in case of promotion on higher executive positions (within certification or unplanned certification or tender);

if its carrying out is provided within the extraordinary certification which is carried out according to the decision of the President of the Republic of Kazakhstan;

in case of certification for the decision of the head of law enforcement agency, authorized body in the field of civil protection, the public courier service of the Republic of Kazakhstan.

4. Main objectives of passing of research are receipt of the additional information and check of reliability of the data reported by the citizens employed in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan (for study in the organization of formation of law enforcement agencies), and law enforcement officers, bodies of civil protection, the public courier service of the Republic of Kazakhstan (further – the inspected persons).

5. The citizens employed in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan (for study in the organization of formation of law enforcement agencies), pass researches in the relevant division of law enforcement agency, body of civil protection, the public courier service of the Republic of Kazakhstan in the direction of personnel division according to appendix 1 to these rules.

5-1. The research of the employee of law enforcement agency, body of civil protection, the public courier service of the Republic of Kazakhstan when conducting office investigation is conducted from its consent.

6. The main objectives of passing of research are identification:

1) in case of acceptance on service in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan (for study in the organization of formation of law enforcement agencies):

illegal intentions of revenues to service in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan (for study in the organization of formation of law enforcement agencies) (for the benefit of activities of the prohibited public associations, the criminal and terrorist organizations and others);

interests in gamblings and (or) bet, the uses of psychoactive agents of synthetic or natural origin (alcohol, drugs, psychotropic substances, their analogs, other stupefying substances) which in case of single acceptance make impact on mental and physical functions, behavior of the person and in case of the long use cause mental and physical dependence;

the hidden diseases interfering full service in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan, suicide bents;

concealments or misstatements of biographical particulars, data on the income, property and obligations of property nature, availability of double citizenship, use of false documents;

earlier being available facts of making of corruption offenses, transfer of classified or office information to strangers;

facts of attraction to disciplinary, administrative and criminal liability, including for making of corruption offenses;

contacts with the prohibited public associations, the criminal and terrorist organizations or participation in commercial structures if it did not belong to their job responsibilities earlier;

abuses of ex-officio full powers;

2) when conducting office investigation:

circumstances of committed offense or offense;

participation of the employee in the available offense or offense;

fact of abuse of ex-officio full powers;

3) in the cases provided by the subitem 3) of Item 3 of these rules:

the hidden negative motives of stay on service in law enforcement agencies, bodies of civil protection, the public courier service of the Republic of Kazakhstan (for the benefit of activities of the prohibited public associations, the criminal and terrorist organizations and others);

interests in gamblings and (or) bet, the uses of psychoactive agents of synthetic or natural origin (alcohol, drugs, psychotropic substances, their analogs, other stupefying substances) which in case of single acceptance make impact on mental and physical functions, behavior of the person and in case of the long use cause mental and physical dependence;
