1. Approve Rules of certification of technical means of protection of civil aviation against acts of illegal intervention which are attached.

2. To provide to the public air service of Ukraine:

1) submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure;

2) promulgation of this order on the official site of the Ministry of infrastructure of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the deputy minister Bondarenko A. E.

Rules of certification of technical means of protection of civil aviation against acts of illegal intervention

I. General provisions

1.1. These Rules establish the procedures applied in case of certification of technical means of protection of the civil aviation (CA) against the acts of illegal intervention (AII) to determination of their compliance to state standards of Ukraine, to other regulating documents and issues of the certificate of conformity.

1.2. These Rules extend to the central executive body, providing realization of state policy in the field of civil aviation, and also subjects of managing which perform activities in the sphere of production and delivery of technical means of protection of GA against ANV, in case of certification and issues (obtaining) of the certificate of conformity on technical means of protection of GA against ANO.

1.3. In these Rules terms are used in the following values:

the certificate holder of compliance - the producer of technical means of protection of GA against ANV who received the certificate of conformity in the procedure established by the legislation;

the statement - the written appeal of producer or his authorized representative in the established form in the central executive body, providing realization of state policy in the field of civil aviation, about receipt of the certificate of conformity;

the certificate of conformity - the document which is issued to the producer according to these Rules and demonstrates that technical means of protection of GA against ANO conform to the state standards established in Ukraine, other regulating documents;

technical means of protection of GA against ANO - the special equipment intended for independent use or use as part of any system for ensuring protection of GA against ANO.

1.4. In these Rules the following values have reducing:

AB - aviation safety;

ANO - the act of illegal intervention;

TsA - civil aviation.

II. Procedure for giving and consideration of the application on certification of technical means of protection of GA against ANO

2.1. The producer or his authorized representative (further - the applicant) for the purpose of receipt of the certificate of conformity submits the application addressed to the head of the central executive body for technical means of protection of GA against ANO, providing realization of state policy in the field of civil aviation (appendix 1) in which originals or verified copies (including in translation in Ukrainian or English) the following documents are attached:

the certificate of conformity on technical means of protection of GA against ANV on compliance to their established standards, other regulating documents;

standards (specifications) on technical means of protection of GA against ANO;

test reports (testing) of technical means of protection of GA against ANO;

certificate of the quality system of the producer;

the document on registration confirmation of the producer in the country of its location;

the letter of the producer which contains information about his authorized representative in Ukraine;

copy of the shipping documentation.

2.2. The statement is registered in the central executive body, providing realization of state policy in the field of civil aviation, in day of its receipt.

2.3. The application is considered on condition of giving of complete set of documents and payment of the state charges for certification according to requirements the Provision about the State specialized fund of the financing of nation-wide expenses on aviation activities and participation of Ukraine in the international aviation organizations approved by the resolution of the Cabinet of Ministers of Ukraine of September 28, 1993 No. 819 (in edition of the resolution of the Cabinet of Ministers of Ukraine of June 16, 1998 No. 889).

2.4. After registration of a statement the central executive body, providing realization of state policy in the field of civil aviation, appoints the commission on consideration of the application and accomplishment of the procedures for determination of compliance of technical means of protection of GA against ANV to requirements of state standards of Ukraine, other regulating documents established by these rules.

The structure of the commission affirms the order of the central executive body providing realization of state policy in the field of civil aviation.

2.5. Certification of technical means of protection of GA against ANO by representatives of the relevant commission of the central executive body, providing realization of state policy in the field of civil aviation, is performed as follows:

preliminary estimations of the statement and documents which are attached to it;

testing (testing) of technical means of protection of GA against ANO, including on production;

execution of the act of certified check by results of work of the commission and preparation of the decision on issue or refusal in issue of the certificate of conformity;

registration and issue of the certificate of conformity;

supervision of technical means of protection of GA against ANO in case of their operation for the purpose of ensuring compliance with state standards of Ukraine, other regulating documents specified in the certificate of conformity.

2.6. Preliminary consideration of the statement and the Protocols attached to it is performed within 10 working days from the date of their registration in the central executive body, providing realization of state policy in the field of civil aviation.
