1. Approve enclosed:

1) standard of the state service "Licensing, Renewal, Issue of Duplicates of the License for Occupation Activities for Development, Production, Repair and Realization of the Special Technical Means Intended for Conducting Investigation and Search Operations";

2) standard of the state service "Licensing, Renewal, Issue of Duplicates of the License for Development and Realization (including Other Transfer) Means of Cryptographic Information Security";

3) standard of the state service "Licensing, Renewal, Issue of Duplicates of the License for Rendering Services in Identification of Technical Channels of Information Leakage and the Special Technical Means Intended for Conducting Investigation and Search Operations";

4) standard of the state service "Issue of the Conclusion (the Allowing Document) for Import to Customs Area of the Customs Union and Export from Customs Area of the Customs Union of the Special Technical Means Intended for Secret Receipt of Information";

5) standard of the state service "Issue of the Conclusion (the Allowing Document) for Import to Customs Area of the Customs Union and Export from Customs Area of the Customs Union of the Cryptography (Cryptographic) Tools";

6) standard of the state service "Carrying Out Technical Research regarding Reference of Goods to the Means of Cryptographic Information Security and Special Technical Means Intended for Conducting Investigation and Search Operations";

2. Declare invalid the order of the Government of the Republic of Kazakhstan of January 29, 2013 No. 50 "About approval of standards of the state services rendered by Committee of homeland security of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2013, No. 12, the Art. 227).

Standard of the state service "Licensing, Renewal, Issue of Duplicates of the License for Occupation Activities for Development, Production, Repair and Realization of the Special Technical Means Intended for Conducting Investigation and Search Operations"

1. General provisions

1. The state service "Licensing, Renewal, Issue of Duplicates of the License for Occupation Activities for Development, Production, Repair and Realization of the Special Technical Means Intended for Conducting Investigation and Search Operations" (further - the state service).

2. The standard of the state service is developed by Committee of homeland security of the Republic of Kazakhstan (further - KNB).

3. The state service is rendered to KNB (further - the service provider).

Reception of applications and issue of results of rendering the state service are performed by the Special KNB information service, including through the web portal of "the electronic government": www.e.gov.kz or E-litsenzirovaniye web portal: www.elicense.kz (further - the portal).

2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the moment of delivery of document package to the service provider, and also in case of the address through the portal:

for licensing - 15 working days;

for renewal of the license - 10 working days;

for issue of the duplicate of the license - 2 working days;

8. Working schedule:

1) the service provider - Monday through Friday inclusive, from 09:00 to 19.00, with lunch break from 13:00 to 15.00, except days off and holidays, according to the labor law of the Republic of Kazakhstan (reception of applications and issue of results of rendering the state service are performed in turn, without making an appointment and the accelerated servicing);

2) the portal - round the clock (except for the breaks connected with carrying out technical works).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (or his representative by proxy):

to the service provider:

1) for receipt of the license:

the statement of the established form according to appendix 1 (for legal entities) or to appendix 2 (for individual entrepreneurs) to this standard of the state service;

the copy of the document confirming payment in the budget of the license fee, except as specified payments through PShEP;

form of data according to qualification requirements according to appendix 3 to this standard of the state service;

2) for renewal of the license:

the statement for renewal of the license in any form with indication of data of the license;

the copy of the document confirming payment in the budget of the license fee, except as specified payments through PShEP;

3) in case of loss, spoil of the license the uslugopoluchatel addresses the service provider for receipt of the duplicate of the license only in the absence of possibility of receipt of data on the license from the corresponding information systems on the portal with submission of the following documents:

the statement for issue of the duplicate of the license in any form (in case of spoil of the license granted on paper the uslugopoluchatel before receipt of the duplicate of the license returns to the service provider earlier issued original of the license);

the copy of the document confirming payment in the budget of the license fee, except as specified payments through PShEP;

on the portal:

1) for receipt of the license:

request in electronic form, the uslugopoluchatel certified by the EDS;

the document confirming payment in the budget of the license fee in the form of the scanned copy is attached to electronic request, except as specified payments through PShEP;

form of data according to qualification requirements in the amount provided by appendix 3 to this standard of the state service;

2) for renewal of the license:

request in electronic form, the uslugopoluchatel certified by the EDS;

the document confirming payment in the budget of the license fee in the form of the scanned copy is attached to electronic request, except as specified payments through PShEP;

3) for receipt of the duplicate of the license:

request in electronic form, the uslugopoluchatel certified by the EDS;

10. The bases for refusal in rendering the state service:

1) occupation type of activity is forbidden by the laws of the Republic of Kazakhstan for this category of uslugopoluchatel;

2) the license fee on the occupation right is not brought by the declared type of activity;

3) the uslugopoluchatel does not conform to qualification requirements;

4) concerning uslugopoluchatel there is court verdict which took legal effect prohibiting to it to be engaged in the declared type of activity;

5) court based on representation of the legal executive the uslugopoluchatel is forbidden to obtain licenses;

6) factual determination of incompleteness of the submitted documents. In case of the request of uslugopoluchatel for receipt of the license, the service provider within two working days from the moment of delivery of document package checks their completeness. In case of factual determination of incompleteness of the submitted documents the service provider within the specified term gives motivated refusal in further review of the statement.

3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) his officials concerning rendering the state service

11. In case of appeal of decisions, actions (failure to act) of the service provider and (or) his officials, the claim is submitted addressed to the head of the service provider.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 working days from the date of its registration.

The answer about results of consideration of the claim goes to uslugopoluchatel by means of mail service or is issued purposely in office of the service provider.

12. In case of disagreement with results of rendering the state service the uslugopoluchatel can take a legal action according to the procedure, established by the legislation of the Republic of Kazakhstan.

4. Other requirements taking into account features of rendering the state service

13. Powers of the representative of uslugopoluchatel shall be drawn up according to the civil legislation of the Republic of Kazakhstan.

14. Receipt of the state service through the portal requires EDS availability.

15. The address of the place of rendering the state service is also placed on the KNB official Internet resource: www.knb.kz.

16. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access on the portal in "private office" of uslugopoluchatel, and also by phones of the service provider and single contact center concerning rendering the state services.
