1. Approve the enclosed Rules of subsidizing of cost of herbicides, bioagents (entomophages) and biological products intended for processing of crops for the purpose of protection of plants.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of subsidizing of cost of herbicides, bioagents (entomophages) and biological products intended for processing of crops for the purpose of protection of plants

1. General provisions

1. These rules of subsidizing of cost of herbicides, bioagents (entomophages) and biological products intended for processing of crops for the purpose of protection of plants (further - Rules) determine payment procedure of subsidies for the account and within the means provided in the local budget for the corresponding financial year (further - subsidies), by reduction in cost to agricultural producers of cost of herbicides, bioagents (entomophages) and biological products intended for processing of crops for the purpose of protection of plants according to the Law of the Republic of Kazakhstan of July 8, 2005 "About state regulation of development of agro-industrial complex and the rural territories".

2. Subsidies are allocated to agricultural producers (further - SHTP) according to the procedure established by these rules in the following directions on:

1) reduction in cost (to 50%) costs of the herbicides registered according to the legislation of the Republic of Kazakhstan;

2) reduction in cost (to 40%) costs of bioagents (entomophages) and biological products.

3. Financing is performed in the procedure established by the legislation of the Republic of Kazakhstan based on the decision of local executive body of area and the cities of Astana and Almaty according to the directions specified in Item 2 of these rules within the means provided in budgets of area and the cities of Astana and Almaty for the corresponding year.

At the same time the amount of means provided in local budgets of area and the cities of Astana and Almaty shall not be lower than the general nature established by the legislation of the Republic of Kazakhstan on amounts of transfers between republican and regional budgets, city budgets of republican value, the capital for the corresponding year of the minimum amount of budgetary funds directed to agricultural industry.

4. Akims of areas, in case of incomplete development by any region of allocated funds, can redistribute them within the approved subsidizing amount on area in the directions specified in Item 2 of these rules.

5. For determination of the SHTP list on receipt of subsidies in each area (the city of regional value, the cities of Astana and Almaty) the decision of the akim of the area (the city of regional value, the cities of Astana and Almaty) creates the interdepartmental commission (further - MVK).

MVK are included representatives:

1) akimat of the area (city of regional value, cities of Astana and Almaty), including departments or Deraptments of Agriculture and land relations of the area (city of regional value, cities of Astana and Almaty);

2) territorial inspection of authorized body in the field of development of agro-industrial complex;

3) branch of regional chamber of entrepreneurs of areas, cities of Astana and Almaty in districts of the respective area, the cities of regional value, the cities of Astana and Almaty (in the presence);

4) scientific and public organizations of agrarian profile (in the presence).

Working body of MVK are department of agricultural industry of the area, and on the cities of Astana and Almaty and the city of regional value - management or department of agricultural industry of akimat of the city (further - department).

6. The department establishes start and end date of documents acceptance for receipt of subsidies and provides the publication of operating procedure of MVK in local mass media with indication of terms of documents acceptance and other necessary data.

7. Amounts of subsidies on areas (depending on the forecast structure of sown areas of priority cultures) are established by the decision of local executive body of area and the cities of Astana and Almaty.

8. Are established by the decision of local executive body of area and the cities of Astana and Almaty in coordination with authorized body in the field of development of agro-industrial complex (further - authorized body):

1) types of subsidized herbicides and regulation of subsidies for 1 liter (kilogram) of the herbicides acquired at suppliers of herbicides;
