1. Approve the enclosed Rules of subsidizing of cost of fertilizers (except for organic).

2. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of subsidizing of cost of fertilizers (except for organic)

1. General provisions

1. These rules of subsidizing of cost of fertilizers (except for organic) (further - Rules) determine payment procedure of subsidies for the account and within the means provided in the local budget for the corresponding financial year (further - subsidies), by reduction in cost to domestic agricultural producers (further - SHTP) costs of fertilizers (except for organic) according to the Law of the Republic of Kazakhstan of July 8, 2005 "About state regulation of development of agro-industrial complex and the rural territories".

2. Akims of areas, in case of incomplete development by any region of allocated funds on reduction in cost of cost of fertilizers (except for organic), can redistribute them between other areas on this direction of subsidizing within the approved subsidizing amount on area.

3. For determination of the SHTP list on receipt of subsidies in each area (the city of regional value, the cities of Astana and Almaty) the decision of the akim of the area (the city of regional value, the cities of Astana and Almaty) creates the interdepartmental commission (further - MVK).

MVK are included representatives:

1) akimat of the area (city of regional value, cities of Astana and Almaty), including departments or Deraptments of Agriculture and land relations of the area (city of regional value, cities of Astana and Almaty);

2) maslikhat of the area (city of regional value, cities of Astana and Almaty);

3) territorial inspection of authorized body in the field of development of agro-industrial complex;

4) branch of regional chamber of entrepreneurs of areas, cities of Astana and Almaty in districts of the respective area, the cities of regional value, the cities of Astana and Almaty (in the presence);

5) scientific and public organizations of agrarian profile (in the presence).

5. Amounts of subsidies on areas (depending on the forecast structure of sown areas of priority cultures) are established by the decision of local executive body of area and the cities of Astana and Almaty.

6. The Deraptment of Agriculture of area (cities of Astana and Almaty) (further - management) places on Internet resource of local executive body of area (cities of Astana and Almaty) individual monthly funding plan of area on subsidizing of cost of fertilizers (except for organic) within three working days after its approval.

7. The decision of local executive body of area (cities of Astana and Almaty) in coordination with authorized body in the field of development of agro-industrial complex (further - authorized body) establishes types of subsidized fertilizers and regulation of subsidies for 1 ton (liter, kilogram) of the fertilizers realized by domestic manufacturers (further - producer of fertilizers), on 1 ton (liter, kilogram) of the fertilizers acquired at the supplier of fertilizers and (or) foreign producers of fertilizers (further - foreign producers of fertilizers). In case of representation on coordination to authorized body of the draft decision of local executive body of area (cities of Astana and Almaty) the documents proving the established subsidy regulation are attached (calculations for amounts of the types of fertilizers which are subject to subsidizing taking into account scientifically based regulations of introduction on the square specified in requests, the documents confirming the developed market prices of the corresponding types of the declared fertilizers).

2. Conditions of payment of subsidies

8. Subsidies for reduction in cost of cost of fertilizers (except for organic) intend for:

1) partial reduction in cost of cost of the fertilizers realized by producers of fertilizers in the current year;

2) partial cost recovery of SHTP which acquired fertilizers at the supplier of fertilizers and (or) it is direct at foreign producers of fertilizers in the current year;

3) partial cost recovery of SHTP which acquired fertilizers in the 4th quarter of previous year at the producer and (or) at the supplier of fertilizers, and (or) at foreign producers of fertilizers.
