About some questions of arrival of citizens of the Russian Federation on Federal public civil service in the territorial authorities of federal executive bodies created in the territories of the Republic of Crimea and Sevastopol

For the purpose of realization of provisions of the Federal constitutional Law of March 21, 2014 "About acceptance to the Russian Federation of the Republic of Crimea and education as a part of the Russian Federation of new subjects - the Republic of Crimea and the federal city of Sevastopol" I decide No. 6-FKZ:

1. Determine that:

a) till January 1, 2015 appointment of citizens of the Russian Federation from number of persons employed of the state bodies located in the territories of the Republic of Crimea and Sevastopol replacing positions in the specified bodies on the date of acceptance to the Russian Federation of the Republic of Crimea and education as a part of the Russian Federation of new subjects - the Republic of Crimea and the federal city of Sevastopol (further - citizens of the Russian Federation), to positions of Federal public civil service in the territorial authorities of federal executive bodies created in the territories of these subjects of the Russian Federation is performed on the terms of the terminal office contracts signed for a period of up to one year;

b) office contracts sine die, and in the cases provided by part 4 of article 25 of the Federal Law of July 27, 2004 No. 79-FZ "About the public civil service of the Russian Federation" - terminal office contracts for a period of one year up to five years are signed with the citizens of the Russian Federation who passed examination for knowledge of the legislation of the Russian Federation, conforming to requirements imposed by the legislation of the Russian Federation to the government civil servants, and appointed (appointed) to positions of Federal public civil service in the territorial authorities of federal executive bodies created in the territories of the Republic of Crimea and Sevastopol;

c) exam is held for knowledge of the legislation of the Russian Federation at citizens of the Russian Federation based on the methodical recommendations approved by the Ministry of Labour and Social Protection of the Russian Federation.

2. Determine that till January 1, 2015 on the citizens of the Russian Federation appointed (appointed) to positions of Federal public civil service in the territorial authorities of federal executive bodies created in the territories of the Republic of Crimea and Sevastopol do not extend the following stipulated by the legislation the Russian Federation about the public civil service prohibitions and obligations:

a) prohibition on participation on paid basis in activities of governing body of the commercial organization;

b) prohibition on implementation of business activity;

c) obligation deliver in trust management according to the civil legislation of the Russian Federation the securities belonging to federal government civil servants, shares (shares, shares in the authorized (share) capital of the organizations) if ownership of securities, shares (shares, shares) brings in the authorized (share) capital of the organizations or can lead to conflict of interest;

3. To provide to heads of federal executive bodies creation in territorial authorities of the federal executive bodies located in the territories of the Republic of Crimea and Sevastopol, divisions of personnel services on prevention of corruption and other offenses or to determine officials of the personnel services responsible for work on prevention of corruption and other offenses.

4. Recommend to the acting as Glavy the Republic of Crimea and the acting as the City governor of Sevastopol to create in executive bodies of the Republic of Crimea and Sevastopol divisions of personnel services on prevention of corruption and other offenses or to determine officials of the personnel services responsible for work on prevention of corruption and other offenses.
