About approval of regulations of the state services

1. Approve:

1) regulations of the state service "Licensing for Import and (or) Commodity Export in case of Application of Measures of Customs and Tariff and Non-tariff Regulation of Foreign Trade Activity, and also Special Protective Measures based on Decisions of the Government of the Republic of Kazakhstan and (or) the Eurasian Economic Commission", according to appendix 1 to this order;

2) regulations of the state Service "Licensing, Renewal, Issue of Duplicates of the Import License of the Goods Which Are Objects of Trial for the Territory of the Republic of Kazakhstan without Application of Quantitative Restrictions", according to appendix 2 to this order;

3) regulations of the state service "Issue of the Import Permit of Separate Types of Goods on the Territory of the Republic of Kazakhstan", according to appendix 3 to this order;

4) regulations of the state service "Licensing, Renewal of the License for the Occupation Right Dealer Activities in the Sphere of Commodity Exchanges", according to appendix 4 to this order;

5) regulations of the state service "Licensing, Renewal of the License for the Occupation Right Broker Activities in the Sphere of Commodity Exchanges", according to appendix 5 to this order;

6) regulations of the state service "Licensing, Renewal of the License for the Occupation Right Activities of Commodity Exchanges", according to appendix 6 to this order.

5. This order becomes effective after ten calendar days after day of its first official publication.

Regulations of the state service "Licensing for Import and (or) Commodity Export in case of Application of Measures of Customs and Tariff and Non-tariff Regulation of Foreign Trade Activity, and also Special Protective Measures based on Decisions of the Government of the Republic of Kazakhstan and (or) the Eurasian Economic Commission"

1. General provisions

1. The state service appears Committee of trade of the Ministry of Economy and Budget Planning of the Republic of Kazakhstan (further - the service provider).

Reception of applications and issue of results of rendering the state service are performed through:

1) service provider;

2) the Republican state company "Service Center of the Population" of the Agency of the Republic of Kazakhstan for communication and information (further - the Center);

3) the web portal of "the electronic government" www.e.gov.kz (further - the portal).

2. Form of rendering the state service: electronic (completely automated) and (or) paper.

In case of receipt of the statement on paper, the executive in charge makes registration of a statement on the portal with filling of all fields;

2) the choice by management of the service provider of the executive in charge in day of receipt of the statement;

3) in case of need within two working days of preparation by the executive in charge of request for coordination in the approving state body;

4) in case of affirmative answer of the approving state body by the executive in charge within eleven working days documents on compliance to the legislation, in case of negative - the motivated answer about refusal in rendering the state service are considered;

5) preparation of the license or motivated answer about refusal in rendering the state service - within one working day;

6) signing by the head of the service provider of the license or motivated answer about refusal in rendering the state service within one working day.

6. Results of the procedure (action) for rendering the state service which form the basis for accomplishment of the following procedure (action):

1) the registered statement with the entering number;

2) completeness of the submitted documents;

3) sending an inquiry in the approving state body;

4) the analysis of replies of the approving state body;

5) the electronic document signed by the EDS of the head of the service provider.

In case of filing of application for rendering the state service:

by electronic method - the result of rendering the state service is drawn up in electronic form;

by paper method - the result of rendering the state service is drawn up in electronic form, unpacked, signed by the head and certified by seal of the service provider.

3. The description of order of interaction of workers of the service provider in the course of rendering the state service

7. The list of workers of the service provider who participate in process of rendering the state service:

The executive in charge who registers (in case of giving of request by electronic or paper method) considers 1) and prepares the draft decision;

2) head of the service provider.

8. The description of the sequence of procedures (actions) between workers with indication of duration of each procedure (action):

1) registration in day of receipt of the statement on the rendering the state service which arrived through the portal / information system of the state database of the E-litsenzirovaniye web portal (further - IS GBD "E-licensing") from uslugopluchatel or on paper;

2) in case of need the direction within two working days in the approving state body;

3) processing within eleven working days of the arrived answer from the approving state body and preparation of the license or motivated answer about refusal in rendering the state service;

4) preparation of the license or motivated answer about refusal in the legend of the state service - within one working day;

5) signing by the head of the service provider within one working day of the license or the motivated answer about refusal in rendering the state service.

4. The description of order of interaction with the center and (or) other service providers, and also procedure for use of information systems in the course of rendering the state service

the statement in the form approved by the Order of the Government of the Republic of Kazakhstan No. 149 of February 25, 2014 of the Standard of the state service "Licensing for Import and (or) Commodity Export in case of Application of Measures of Customs and Tariff and Non-tariff Regulation of Foreign Trade Activity, and also Special Protective Measures based on Decisions of the Government of the Republic of Kazakhstan and (or) the Eurasian Economic Commission" (further - the Standard);

the copy of the document on registration in tax authority;

the copy of the license for implementation of the licensed type of activity if such type of activity is connected with circulation of goods concerning which licensing on single customs area of the Customs union is introduced;

the document confirming payment in the budget of the license fee for the occupation right with separate types of activity;

other documents if they are determined by the decision of the commission based on which licensing of this type of goods is entered.

Each leaf of the provided copies of documents shall be certified by the sign and seal of uslugopoluchatel, or copies of documents shall be stitched and certified by the sign and seal of uslugopoluchatel.
