1. Approve Provisional Regulations "About payment cards of the Central Treasury of the Ministry of Finance of the Kyrgyz Republic" it (is applied).

2. To legal management:

- publish this resolution on the official site of National Bank of the Kyrgyz Republic;

- after official publication to send this resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State register of regulatory legal acts of the Kyrgyz Republic.

3. This resolution becomes effective after 15 days from the date of official publication.

4. To management of payment systems to bring this resolution to the attention of the Central Treasury of the Ministry of Finance of the Kyrgyz Republic, Interbank Processing Center Ltd and commercial banks of the Kyrgyz Republic.

5. To impose control of execution of this resolution on the vice-chairman of National Bank of the Kyrgyz Republic Zheenbayeva B. Zh.

Provisional regulations for payment cards of the Central Treasury of the Ministry of Finance of the Kyrgyz Republic

Chapter 1. General provisions

1. These Provisional Regulations determine procedure for issue by the Central Treasury of the Ministry of Finance of the Kyrgyz Republic (further - Treasury) corporate payment cards (further - payment cards of Treasury) and their transfers to the organizations within realization of pilot project "The card of the receiver of budgetary funds", and also procedure for carrying out the Kyrgyz Republic by commercial banks (further - banks) acquiring of payment cards of Treasury and processing of the transactions made with their use.

2. The decision on participation of Treasury in national payment system is made by the Ministry of Finance of the Kyrgyz Republic in coordination with National Bank of the Kyrgyz Republic (further - National Bank).

3. For implementation of activities for issue of the Treasury payment cards signs the General agreement with National Bank and the operator of national settlement system payment cards.

4. The relations between participants of calculations with use of payment cards which are not settled by these Provisional Regulations, their responsibility, the rights and obligations are regulated by the relevant agreements and operational rules of national settlement system payment cards.

Chapter 2. Determinations

5. In these Provisional Regulations the following terms and their determinations are used:

1) payment card of Treasury - the payment instrument allowing the organization to perform operations according to corporate cards based on the contract signed by Treasury with the operator of national settlement system payment cards. Card transactions of Treasury are performed by the card holder within cash amount, listed by Treasury. The card is property of Treasury and is provided in use of state-financed organization according to this Provision, the established procedure of Treasury and terms of the contract with the operator of national payment system. The organization charges use of the card to the card holder;

2) the card holder - person authorized by the organization to make transactions with use of payment card of Treasury based on the power of attorney and/or other documents according to the legislation of the Kyrgyz Republic and requirements of Treasury;

3) the organization - the state body, local government body, state-financed organization which received payment card of Treasury in use;

4) processing - the activities including collection, processing and mailing to participants of calculations of information on the transactions made with use of cards and also accomplishment of other functions provided by the relevant contracts between participants of settlement system with use of cards;

5) the processing center - Interbank Processing Center private company, the operator of national settlement system the Elkart payment cards;

6) participants of calculations with use of payment cards of Treasury - Treasury, card holder, ekvayer, processing center;

7) ekvayer - the commercial bank performing acquiring of payment cards of Treasury in compliance the procedure and conditions established in operational rules of system and the legislation of the Kyrgyz Republic;

8) maps checks - the paper document created by the terminal, the ATM or other device when carrying out transaction with use of the card, which is the basis for implementation of calculations for transaction and serving as confirmation of its making.

6. In the relations between Treasury and other participants of settlement system with use of payment cards of Treasury terms and concepts which are determined by the Regulations on bank payment cards in the Kyrgyz Republic approved by the resolution of Board of National Bank of the Kyrgyz Republic of October 14, 2009 No. 41/7 are also applied.

Chapter 3. Obligations and functions of treasury in case of issue of payment cards

7. Activities of Treasury for issue of payment cards of Treasury are performed according to obligations and functions of Treasury according to the Law of the Kyrgyz Republic "About basic provisions of Treasury of the Kyrgyz Republic".

8. The treasury is payment card issuer of Treasury for the organizations based on national settlement system the Elkart payment cards.

9. Activities of Treasury for issue of payment cards of Treasury shall include (but not to be limited) the following:

1) creation of necessary technical base and system regular (at least 1 time a quarter) internal check regarding its reliable technical condition, fulfillment of requirements for stable work and data protection;

2) creation of system of internal accounting and reporting under payment cards of Treasury;
