About questions of National guard of the Kyrgyz Republic

For the purpose of determination of activities of National guard of the Kyrgyz Republic, in view of provisions of the Presidential decree of the Kyrgyz Republic "About National guard of the Kyrgyz Republic" of March 12, 2014 56, being guided No. by articles 10, of the 17th constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic decides:

1. Approve enclosed:

- Regulations on National guard of the Kyrgyz Republic;

- scheme of management of National guard of the Kyrgyz Republic.

2. To the Ministry of Defence of the Kyrgyz Republic and the Ministry of Internal Affairs of the Kyrgyz Republic in two-month time:

- submit in accordance with the established procedure for consideration of the Government of the Kyrgyz Republic the regulatory legal acts following from this resolution;

- bring the decisions into accord with this resolution.

3. Declare invalid the order of the Government of the Republic Kyrgyzstan "About approval of the Regulations on internal troops and the text of the Oath of the serviceman of internal troops of the Republic Kyrgyzstan" of June 2, 1992 No. 262.

4. This resolution becomes effective from the date of official publication.

5. To impose control of execution of this resolution on department of defense, law and order and emergency situations of Government office of the Kyrgyz Republic.

Regulations on National guard of the Kyrgyz Republic

1. General provisions

1. The national guard of the Kyrgyz Republic (further - National guard) is the special military forming as a part of Armed Forces of the Kyrgyz Republic (further - Armed Forces) intended for protection of the state sovereignty, territorial integrity, the constitutional system, society and citizens of the Kyrgyz Republic, and also accomplishment of office and fighting tasks on protection of the state and strategic objects.

The national guard is legal entity in form of business - organization, has the symbolics, the Battle Flag, seal with the image of the State Emblem of the Kyrgyz Republic, the name in the state and official languages, the seals, stamps and forms necessary for implementation of the activities, and also accounts opened according to the legislation of the Kyrgyz Republic.

The legal basis of activities of National guard the Constitution of the Kyrgyz Republic, the Law of the Kyrgyz Republic "About defense and Armed Forces of the Kyrgyz Republic" constitute, other regulatory legal acts of the Kyrgyz Republic which came in the procedure established by the law into force the international agreements which participant is the Kyrgyz Republic and this Provision.

4. Activities of National guard of the Kyrgyz Republic are based on the basis of the principles:

2. Tasks and functions of National guard

6. The following tasks are assigned to National guard:

1) participation in protection of the constitutional system, state sovereignty, independence and territorial integrity of the country;

2) implementation of actions in the conditions of the mode of military and extraordinary provisions according to the procedure, stipulated by the legislation the Kyrgyz Republic;

3) participation in territorial defense of the Kyrgyz Republic;

4) protection of the state and strategic objects which list and rules of protection are determined by the Government of the Kyrgyz Republic;

5) interaction with the authorized state bodies knowing national security issues and internal affairs of the Kyrgyz Republic concerning safety of the protected objects;

6) accomplishment of other tasks determined by the legislation of the Kyrgyz Republic.

7. For accomplishment of the assigned tasks the National guard performs the following functions:

1) implementation of actions on maintenance of combat readiness;

2) participation in activities for maintenance of international peace and safety according to the legislation of the Kyrgyz Republic;

3) participation in liquidation of illegal armed groups and effects of emergency situations of natural and technogenic nature;

4) participation in fight against terrorism, religious extremism and separatism within the powers;

5) participation in actions, according to  the Law of the Kyrgyz Republic "About defense and Armed Forces of the Kyrgyz Republic";

6) execution of honourable guard duty in case of meetings and wires of Chapters of foreign states and at the National flag of the Kyrgyz Republic placed into the square "It is scarlet - Limited liability partnership" the cities of Bishkek;

7) participation in accomplishment of ceremonial rituals when holding hospitality events;

8) the organization of protection and access control on the protected objects;

9) interaction within competence with law enforcement and other state bodies, local government bodies, legal entities and physical persons;

10) organization of cooperation with the relevant structures of foreign states, program implementation of military and military and technical cooperation;

11) ensuring protection of the data which are the state, military and official secret;
