About the Ministry of Defence of the Kyrgyz Republic

- Regulations on the Ministry of Defence of the Kyrgyz Republic;

- scheme of management of the Ministry of Defence of the Kyrgyz Republic.

2. Determine that military units and organizations of the Ministry of Defence of the Kyrgyz Republic have rights of the legal entity.

3. To the Ministry of Defence of the Kyrgyz Republic to bring the decisions into accord with this resolution.

4. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About the Ministry of Defence and General staff of Armed Forces of the Kyrgyz Republic" of May 26, 2012 No. 321;

- the order of the Government of the Kyrgyz Republic "About entering of amendments into the order of the Government of the Kyrgyz Republic "About the Ministry of Defence and General staff of Armed Forces of the Kyrgyz Republic" of May 26, 2012 No. 321" of August 3, 2012 No. 538;

- Item 2 of the order of the Government of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic" of January 24, 2013 No. 32.

Regulations on the Ministry of Defence of the Kyrgyz Republic

1. General provisions

1. The Ministry of Defence of the Kyrgyz Republic (further - the Ministry of Defence) is the state body of the executive authority knowing questions of defense, realizing the state military policy.

2. The Ministry of Defence in the activities is guided by the Constitution of the Kyrgyz Republic, the laws and other regulatory legal acts of the Kyrgyz Republic, international treaties which came in the procedure established by the law into force which participant is the Kyrgyz Republic, and also this Provision.

3. The Ministry of Defence is legal entity, has the symbolics, seal with the image of the State Emblem of the Kyrgyz Republic and the name in the state and official languages. The Ministry of Defence enters the civil relations from own name, has the right to act as the party of the civil relations on behalf of the state within the legislation of the Kyrgyz Republic.

4. Financing of the Ministry of Defence and its subordinated divisions is performed at the expense of the republican budget and other sources of financing which are not forbidden by the legislation of the Kyrgyz Republic. The Ministry of Defence has the special account in system of Treasury.

2. Tasks of the Ministry of Defence

5. The following tasks are assigned to the Ministry of Defence:

1) development of offers on determination of the state military policy and realization of the state military policy within the competence of the Ministry of Defence determined by the legislation on defense and this Provision;

2) implementation of the common directorship realization of military policy of the state within the competence of the Ministry of Defence determined by the legislation on defense and this Provision;

3) carrying out single policy on enhancement of arms and military equipment;

4) the organization within competence of the Ministry of comprehensive providing military units and organizations of the Ministry of Defence and the General Staff of Armed Forces of the Kyrgyz Republic (further - the General Staff of Armed Forces);

5) providing social and legal protection of the military personnel, civil personnel of Armed Forces, persons discharged from military service, members of their families and families of the died military personnel.

3. Functions of the Ministry of Defence

6. For accomplishment of the assigned tasks the Ministry of Defence performs the following functions:

1) participation in project development of the Concept of homeland security, the Military doctrine, mobilization plans of economy of the Kyrgyz Republic, and also drafts of state programs and work plans on ensuring defense and their realization within the conferred powers;

2) implementation of the international military and military and technical cooperation;

3) the organization of work on enhancement of the legislation in the sphere of defense and ensuring its realization in Armed Forces and other military forming;

4) plan development (programs) of construction (development) of Armed Forces and control of their realization within the competence of the Ministry of Defence determined by the legislation on defense and this Provision;

5) comprehensive ensuring realization:

- plans (programs) of construction (development), preparation and use of Armed Forces;

- mobilization plans, plans of the operational equipment of the territory of the state for the benefit of defense, dislocation of troops and military facilities;

- plans of ensuring military safety of the Kyrgyz Republic, use of Armed Forces and territorial defense;

6) participation in development and implementation of state programs of development of defensive production;

7) development of offers on the organization of ensuring territorial defense, protection of frontier, prevention and mitigation of consequences of emergency situations;

8) development of offers on defense expenditure of the state when forming the budget and to the state defensive order;

9) participation in military patriotic education of citizens of the Kyrgyz Republic;

10) the organization of training for Armed Forces and work on development of military science;

11) development and entering of offers into the Government of the Kyrgyz Republic on the organization of training of citizens for military service according to the legislation of the Kyrgyz Republic;

12) development of offers on procedure for passing of military service;

13) by calculations of the General Staff of Armed Forces submission of requests to the Government of the Kyrgyz Republic for financial and comprehensive provision of Armed Forces, the organization of creation and accumulating of arms, military equipment and other inventories of appliances in the state;

14) participation in creation and accumulating of arms, military equipment and other inventories of appliances in the state;
