According to article 26 of the Law of Ukraine "About the refugees and persons needing additional or temporary protection" and article 11 of Bases of the legislation of Ukraine about health care the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for provision of medical care to foreigners and stateless persons which constantly live or temporarily are in the territory of Ukraine which filed petition for recognition by the refugee or person needing additional protection on which the decision on document creation for the solution of question of recognition by the refugee or person needing additional protection, and recognized as refugees or persons who need additional protection is made, and compensations of cost of the medical services and medicines provided to the foreigners and persons without citizenship who are temporarily living or being in the territory of Ukraine it (is applied).

To the Ministry of Foreign Affairs to inform the governments of foreign states on approval of the specified Procedure.

2. Declare invalid the resolution of the Cabinet of Ministers of Ukraine of June 22, 2011 No. 667 "About approval of the Procedure for delivery of health care to foreigners and stateless persons which temporarily are in the territory of Ukraine, and recognition voided some resolutions of the Cabinet of Ministers of Ukraine" (The Official Bulletin of Ukraine, 2011, No. 47, of the Art. 1910).

Procedure for provision of medical care to foreigners and stateless persons which constantly live or temporarily are in the territory of Ukraine which filed petition for recognition by the refugee or person needing additional protection on which the decision on document creation for the solution of question of recognition by the refugee or person needing additional protection, and recognized as refugees or persons who need additional protection, and compensation of cost of the medical services and medicines provided to the foreigners and persons without citizenship who are temporarily living or being in the territory of Ukraine is made

1. This Procedure regulates procedure for granting healthcare institutions of the state and municipal pattern of ownership (further - healthcare institutions) medical care:

to foreigners and stateless persons which temporarily are in the territory of Ukraine;

to foreigners and stateless persons which constantly live in the territory of Ukraine;

to foreigners and stateless persons:

- filed petition for recognition by the refugee or person needing additional protection;

- on which the decision on document creation for the solution of question of recognition by the refugee or person needing additional protection is made;

- recognized as refugees or persons who need additional protection.

2. To the foreigners and persons without citizenship who are temporarily living or being in the territory of Ukraine, medical care is provided on paid basis if other is not provided by international treaties or the laws of Ukraine.

The cost of the medical care provided to the foreigner or the stateless person who temporarily are in the territory of Ukraine is determined by healthcare institution which presented her, in the procedure established by the Ministry of Health, except separate research establishments of National academy of medical sciences in which the new mechanism of financial provision of provision of specialized medical care takes root and implemented.

Payment of cost of the medical care provided to foreigners and stateless persons which temporarily are in the territory of Ukraine can be performed in non-cash or cash form in national currency.

2-1. If provision of the medical services and medicines connected with rendering the emergency medical care is paid at the expense of means of the government budget for the program of the state guarantees of medical attendance of the population (the program of medical guarantees), the foreigners or persons without citizenship who are temporarily living or being in the territory of Ukraine shall compensate to the state their all-in cost according to the law.

Compensation of all-in cost of the rendered medical services and medicines is performed by transfer by the foreigner or stateless person who is temporarily living or being in the territory of Ukraine, to the supplier of medical services of all-in cost of the medical services and medicines provided to such person.

All-in cost of the medical services and medicines connected with rendering the emergency medical care is determined at the level not below their cost which is calculated the supplier of medical services and is reflected in the account.

The supplier of medical services shall provide to the foreigner or the person without citizenship who is temporarily living or being in the territory of Ukraine or their legal representatives the account with indication of the amount which is subject to compensation. The foreigner or the person without citizenship who is temporarily living or being in the territory of Ukraine or their legal representatives shall pay such compensation amount for the account before departure out of limits of the territory of Ukraine.

The supplier of medical services within 30 calendar days from receipt date of compensation amount shall transfer into the government budget the amount of means paid to it by NSZU according to rate for provision of the corresponding medical services and medicines to the foreigner or the person without citizenship who are temporarily living or being in the territory of Ukraine.

The supplier of medical services shall report to Administration of State frontier service electronically about the foreigners or persons without citizenship who are temporarily living or being in the territory of Ukraine to whom the medical services and medicines connected with provision of the emergency medical care no later than the next day after provision of such medical services, for taking measures to ensuring compensation by such persons of all-in cost of the rendered medical services and medicines were provided.
