About the state registration of production objects

For the purpose of implementation of the Decision of the Commission of the Customs union of December 9, 2011 "About adoption of the technical regulation of the Customs union "About safety of food products" the Council of Ministers of the Republic of Belarus DECIDES: No. 880

1. Approve Regulations on procedure for the state registration of production objects on which activities for obtaining, conversion (processing) of not processed food (food) staples of animal origin are performed it (is applied).

2. No. 175 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 25.03.2022

3. Determine that:

3.1. the legal entities and individual entrepreneurs performing activities for obtaining, conversion (processing) of not processed food (food) staples of animal origin till February 15, 2015 perform the state registration of the production objects belonging to them according to the procedure, established by this resolution;

3.2. till February 15, 2015 productive activity of the legal entities and individual entrepreneurs performing activities for obtaining, conversion (processing) of not processed food (food) staples of animal origin on the production objects which are not included in the register of the production facilities for production of food products which are subject to the state registration is allowed.

4. This resolution becomes effective from the date of its official publication.

Regulations on procedure for the state registration of production objects on which activities for obtaining, conversion (processing) of not processed food (food) staples of animal origin are performed

1. This Provision determines procedure for the state registration of production objects on which activities for obtaining, conversion (processing) of not processed food (food) staples of animal origin are performed (further - production objects).

2. Action of this provision extends to applicants - legal entities and individual entrepreneurs who perform activities for obtaining, conversion (processing) of not processed food (food) staples of animal origin (further, unless otherwise specified, - applicants), including on:

to slaughter of productive animals and birds, conversion (processing) of killing products of such animals and birds for production (production) of food products;

to acceptance of raw milk, raw cream and raw skim milk and (or) their conversion (processing) for production (production) of dairy products;

to production (production) and conversion (processing) of eggs of agricultural bird and products of their conversion;

to production (production) and conversion (processing) of products of aquaculture and catch of water biological resources (not fish objects of trade), except for products of plant origin.

3. Action of this provision does not extend to the production objects relating to objects of public catering.

4. The state registration of production objects is performed by Department of veterinary and food supervision of the Ministry of Agriculture and Food (further - Department).

5. For the state registration of production objects applicants submit to Department the application in the form established by the Ministry of Agriculture and Food.

6. The department within 30 days from the date of receipt of the statement for the state registration of production object will organize and carries out, including together with other state bodies, check of compliance of the registered production objects to requirements to the production processes (production) of food products established in acts of the legislation, including in technical regulatory legal acts. The specified inspection is carried out according to the procedure, established by the Ministry of Agriculture and Food.

7. The state registration of production objects of the legal entities and (or) individual entrepreneurs included in the register of the organizations and persons performing production, conversion and (or) storage of the controlled goods moved from the territory of one state member of the Customs union on the territory of other state member of the Customs union is performed based on the submitted application without conducting the check provided in Item 6 of this provision.

8. By results of conducting check of the registered production object according to Item 6 of this provision the Department makes the decision on the state registration of production object with assignment to it identification (accounting) number and inclusion of information on production object in the register of the production facilities for production of food products which are subject to the state registration (further - the register), or issues the instruction about elimination of the revealed violations of acts of the legislation, including technical regulatory legal acts.

9. The department shall perform accomplishment of the issued instruction about elimination of the revealed violations of acts of the legislation, including technical regulatory legal acts, within 15 working days from the moment of receipt of the notification on accomplishment of this instruction and elimination of all revealed violations and to make the decision on the state registration of production object or refusal in its state registration.

10. The bases for refusal in the state registration of production object are:

non-compliance with requirements imposed to form or contents of the statement;

failure to carry out of the instruction of Department about elimination of the revealed violations of acts of the legislation, including technical regulatory legal acts;

the bases provided in article 25 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures".

11. In case of decision making about refusal in the state registration of production object the Department in writing notifies on it the applicant no later than seven working days from the date of adoption of such decision with indication of the bases for its acceptance.

In liquidation cases (the activities termination), the death of the interested person the applicant is not notified on the made decision.

12. The refusal in the state registration of production object shall be handed to the applicant's representative personally or is directed to the applicant by the mailing with the assurance of receipt.

13. The register joins information:

about identification (accounting) number of production object;

about the name and the location of the legal entity;

about surname, own name, middle name (if that is available) the individual entrepreneur, and also about data of the identity document;

about the actual address of production object;

about the list of the performed production processes (production) of food products.
