1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) publication of this order on Internet resource of the Agency of the Republic of Kazakhstan on regulation of natural monopolies, after official publication in mass media.

3. To department of administrative work of the Agency of the Republic of Kazakhstan on regulation of natural monopolies after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan:

To provide 1) in the procedure established by the legislation its official publication in mass media with the subsequent provision in Legal department of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of data on publication;

2) to bring it to the attention of structural divisions, territorial authorities of the Agency of the Republic of Kazakhstan on regulation of natural monopolies;

Chapter 1. General provisions

1. Ceiling this Method of calculation of prices for commodity gas of subjects of the controlled market (further - the Technique) is developed according to the Law of the Republic of Kazakhstan of July 9, 1998 "About natural monopolies and the controlled markets", the Law of the Republic of Kazakhstan of January 9, 2012 "About gas and gas supply" and the Rules of pricing in the controlled markets, approvals and adjustments of investing program (project) of the subject of the controlled market approved by the order of the Minister of national economy of the Republic of Kazakhstan of December 29, 2014 No. 174 (registered in the Register of state registration of regulatory legal acts for No. 10705) (further - Rules of pricing).

2. This Technique determines the principles and the mechanism of calculation of the differentiated prices of commodity gas for customer groups by marginal differentiation of the prices of wholesale of commodity gas in the domestic market approved by the order of the Government of the Republic of Kazakhstan (taking into account rate for transportation by trunk gas pipelines and gas storage) separately for each area, the city of republican value, the capital (further - wholesale purchase prices).

3. The fundamental principles of the Technique are:

1) achievement of equal profitability from gas sale on customer groups;

2) stimulation of consumers to economical use of commodity gas, use of resource-saving technologies;

3) compensation of economically reasonable costs connected with rendering services in gas supply;

4) possibility of profit earning, the subject of the controlled market providing effective functioning.

4. The concepts and terms used in this Technique are applied according to the legislation of the Republic of Kazakhstan on natural monopolies and the controlled markets and on gas and gas supply.

5. Ceiling forming of prices for commodity gas is performed according to Rules of pricing.

Chapter 2. Determination of customer groups

6. For the purpose of establishment of the differentiated ceiling prices for commodity gas the following customer groups are allocated:

The I customer group - the residential customers (population) receiving commodity gas from gas-distribution system, the heat power companies in amounts of consumption of commodity gas on production of heat energy for the population (further - energy industry for the population);

The II customer group - the state-financed organizations containing at the expense of budgetary funds;

III customer group - the other consumers who are not entering the first and second customer groups.

Chapter 3. Method of ceiling calculation of prices for commodity gas for customer groups

7. Ceiling prices for commodity gas for each customer group are determined according to Rules of pricing and approved by authorized body.

For II and III customer groups the separate transportation agreement of gas on gas-distribution system is signed.

8. The ceiling structure of price for commodity gas for the first customer group for the population consists from:

wholesale price for commodity gas taking into account its differentiation for the first customer group;

costs of the gas-distributing organization for realization of commodity gas;

rate for transportation of commodity gas on gas-distribution system.

9. The ceiling structure of price for commodity gas for the first customer group, energy industry for the population making thermal energies for the population consists from:

wholesale price for commodity gas taking into account its differentiation for the first customer group;

costs of the gas-distributing organization for realization of commodity gas.
