1. Approve the enclosed Regulations on Service of the state protection of the Republic of Kazakhstan.

2. Approve the enclosed changes and additions which are made to some presidential decrees of the Republic of Kazakhstan.

3. Recognize invalid some acts of the President of the Republic of Kazakhstan according to appendix to this Decree.

4. This Decree becomes effective from the date of signing.

Regulations on Service of the state protection of the Republic of Kazakhstan

Chapter 1. General provisions

1. Service of the state protection of the Republic of Kazakhstan (further - Service of the state protection) - the special state body directly subordinate and accountable to the President of the Republic of Kazakhstan relating to forces of ensuring national security of the Republic of Kazakhstan and performing security actions for safety of the President of the Republic of Kazakhstan, other protected persons and objects within the competence established by the legislation.

2. The service of the state protection has department - Forces of special function of Service of the state protection (further - Forces of special function).

Forces of special function are military forming.

3. The service of the state protection performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

The number of employees of Service of the state protection is established by the Chief of Service of the state protection within the funds allocated for these purposes.

Chapter 2. Tasks and powers of Service of the state protection

13. Tasks:

1) safety of the President of the Republic of Kazakhstan and other protected persons;

2) identification, the prevention and suppression of the offenses directed against life, health, the rights, freedoms, advantage of the personality and property of the President of the Republic of Kazakhstan and other protected persons;

3) protection of property, ensuring public order and safety on the protected objects and in other places of stay of protected persons;

4) implementation within the powers of counteraction to terrorism;

5) forecasting and identification of threats to protected persons and objects, implementation of complex of operational measures for their prevention and neutralization;

6) implementation of protection of standards of National Flag of the Republic of Kazakhstan and State Emblem of the Republic of Kazakhstan and participation in accomplishment of ceremonial and hospitality events;

7) organization of providing with presidential communication;

8) other tasks determined by the laws and acts of the President of the Republic of Kazakhstan.

1) rights:

check in case of entrance (entrance) for the protected objects and in case of exit (departure) from them at physical persons identity documents, carry out their personal inspection (except for protected persons), examination of the things which are in case of them, examination of vehicles and the things taken on them, including using technical means;

if necessary to create operational staff on holding security actions (further - operational staff) which status and powers are determined by the provision approved by the joint order of the state bodies which are part of republican operational staff on holding security actions;

make inquiry within the powers established by the laws of the Republic of Kazakhstan;

make offers and (or) instructions on elimination of the circumstances promoting making of the offenses encroaching on life, health, the rights, freedoms, personal advantage and property of protected persons;

create the separate divisions which are not subject to accounting registration in authorized body out of the location of Service of the state protection;

use service premises, vehicles, communication and other property of state bodies and organizations, and also on contractual basis residential and other property of citizens, and in urgent cases - means of communication of citizens;
