Rules of decision making about preparation and realization of budget investments in objects of state-owned property of the Russian Federation by budget funds of the Pension Fund of the Russian Federation

1. These rules establish procedure for decision making about preparation and realization of budget investments by budget funds of the Pension Fund of the Russian Federation (further respectively - investments, Fund) in capital construction projects of state-owned property of the Russian Federation and (or) on acquisition of real estate units in state-owned property of the Russian Federation (further - capital construction projects, real estate units) in the form of capital investments in the fixed assets of Fund (its territorial authority, organization subordinated to it) which are (which will be) in state-owned property of the Russian Federation (further - the decision).

2. The concepts used in these rules mean the following:

"preparation of investments into capital construction projects and (or) real estate units" - determination of capital construction projects, in construction (reconstruction, including with restoration elements, modernization) whom it is necessary to perform investments, and (or) real estate units for the purpose of which acquisition it is necessary to perform investments, and amount of budgetary appropriations necessary for this purpose, including (if necessary) acquisition of the parcels of land under construction, preparation of the project documentation or acquisition of rights use of the standard project documentation, information on which is included in the register of the standard project documentation, and carrying out the engineering researches which are carried out for preparation of such documentation and also determination of the state customers, customers (builders) concerning capital construction projects and (or) real estate units;

"realization of investments into capital construction project and (or) the real estate unit" - implementation of investments into construction (reconstruction, including with restoration elements, modernization) capital construction project and (or) on acquisition of the real estate unit, including (if necessary) acquisition of the parcel of land under construction, preparation of the project documentation or acquisition of rights use of the standard project documentation, information on which is included in the register of the standard project documentation, and carrying out the engineering researches which are carried out for preparation of such documentation.

3. The governing body of Fund which is the main manager of budget funds of Fund acts as the initiator of preparation of the draft decision.

4. Selection of capital construction projects, in construction (reconstruction, including with restoration elements, modernization) whom it is necessary to perform investments, and also real estate units for the purpose of which acquisition it is necessary to perform investments it is made taking into account:

a) priorities and the purposes of development of Fund for the medium-term and long-term periods;

b) orders and instructions of the President of the Russian Federation and orders of the Government of the Russian Federation;

c) results carried out in the evaluation procedure of efficiency of use of the budget funds of Fund allocated for capital investments determined by governing body of Fund;

d) requirements of Fund (its territorial authority, organization subordinated to it) for capital construction projects and (or) real estate units.

5. The governing body of Fund prepares the draft decision:

concerning capital construction project or the real estate unit estimated or expected (extreme) cost or acquisition value 1, 5 billion rubles and more

in the form of the project of regulatory legal act of the Government of the Russian Federation;

concerning capital construction project or the real estate unit the estimated or expected (extreme) cost or acquisition value less 1, 5 billion rubles - in the form of the draft of the legal act of governing body of Fund.

The draft decision can include several capital construction projects and (or) real estate units.

6. The draft decision contains the following information concerning each capital construction project or the real estate unit:

a) the name of capital construction project according to the project documentation (according to the passport of the investment project concerning capital construction project - in case of absence approved in the procedure for the project documentation established by the legislation of the Russian Federation for date of preparation of the draft decision) or the name of the real estate unit according to the passport of the investment project concerning the real estate unit (further - the investment project);

b) the direction of investment (construction, reconstruction, including with restoration elements, modernization, acquisition);

c) name of the main manager and state customer;

d) name of the customer (builder);

e) the capacity (capacity surplus) of capital construction project which is subject to input, capacity of the real estate unit;

e) term of commissioning (acquisition) of object;

g) estimated cost of capital construction project (in the presence of the approved project documentation) either the expected (extreme) project cost of capital construction or acquisition value of the real estate unit according to the passport of the investment project with allocation of the volume of investment for preparation of the project documentation or acquisition of rights use of the standard project documentation, information on which is included in the register of the standard project documentation (concerning residential and office buildings, buildings for social, cultural and household purposes), and carrying out the engineering researches which are carried out for preparation of such project documentation if investments on the specified purposes are provided (in the prices of the corresponding years of implementation of the investment project);
