Regulations on federal state ecological supervision

1. This Provision establishes procedure of federal state ecological supervision.

2. Federal state ecological supervision is directed to the prevention, identification and suppression of violations by legal entities, individual entrepreneurs and citizens of the requirements in the field of environmental protection established by international treaties of the Russian Federation, the Federal Laws and regulatory legal acts of the Russian Federation adopted according to them (further - mandatory requirements), by means of the organization and conducting checks of specified persons, acceptance of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of effects of the revealed violations.

3. Federal state ecological supervision is exercised by Federal Nature Management Supervision Service and its territorial authorities within the competence within:

a) federal state supervision of geological studying, rational use and protection of subsoil, the state land supervision, the state supervision in the field of protection of atmospheric air, the state supervision in the field of use and protection of water objects, federal state forest supervision (forest protection) on lands of especially protected natural territories of federal importance, federal state supervision in the field of protection, reproduction and use of objects of fauna and the circle of their dwelling in especially protected natural territories of federal importance, federal state hunting supervision in especially protected natural territories of federal importance, the state supervision in the field of protection and use of especially protected natural territories of federal importance (except for especially protected natural territories of federal importance, control of which is exercised of the federal state budgetary institutions which are under authority of the Ministry of Natural Resources and Environmental Protection of the Russian Federation (the national natural parks and national parks) - according to the procedure, established by orders of the Government of the Russian Federation about the corresponding types of supervision;

b) the state supervision in the field of the address with waste, the state ecological supervision on the continental shelf of the Russian Federation, the state ecological supervision in internal sea waters and in the territorial sea of the Russian Federation, the state ecological supervision in exclusive economic zone of the Russian Federation, the state ecological supervision in the field of protection of Lake Baikal, federal state control (supervision) in the field of fishery and preserving water biological resources in especially protected natural territories of federal importance, the state supervision of observance of requirements to the treatment of the substances destroying ozone layer, - according to the procedure, established by this Provision.

3(1). When implementing federal state ecological supervision regarding the types of supervision determined by Item 7 of the list of types of federal state control (supervision) to which the risk - the oriented approach is applied, No. 806 approved by the order of the Government of the Russian Federation of August 17, 2016 "About application the risk - the oriented approach under the organization of separate types of the state control (supervision) and introduction of amendments to some acts of the Government of the Russian Federation", is applied risk - the oriented approach.

Federal state ecological supervision is exercised when implementing economic and other activity with use of the objects which are in accordance with the legislation of the Russian Federation under authority of the Russian Federation, and the objects making negative impact on the environment according to the list of such objects established by the Ministry of Natural Resources and Environmental Protection of the Russian Federation.

5. The Federal Nature Management Supervision Service and its territorial authorities when implementing federal state ecological supervision in accordance with the established procedure interact with federal executive bodies and their territorial authorities, bodies of prosecutor's office, public authorities of subjects of the Russian Federation, local government bodies, the organizations and citizens.

6. The officials of Federal Nature Management Supervision Service and its territorial authorities authorized on implementation of federal state ecological supervision are:

a) the Head of the Federal Service for the Oversight of Natural Resources who is the chief state inspector of the Russian Federation in the field of environmental protection;

b) the deputy managers, chiefs of managements of Federal Nature Management Supervision Service knowing questions of the organization and implementation of federal state ecological supervision and being deputy chief state inspectors of the Russian Federation in the field of environmental protection;

c) the deputy chiefs of managements, chiefs of departments and deputy chiefs of departments of Federal Nature Management Supervision Service knowing questions of the organization and implementation of federal state ecological supervision and being the chief state inspectors of the Russian Federation in the field of environmental protection;

d) the federal government civil servants of category "specialists" of the leading and senior groups of positions of Federal Nature Management Supervision Service knowing questions of the organization and implementation of federal state ecological supervision and being the state inspectors of the Russian Federation in the field of environmental protection;

e) the heads of territorial authorities of Federal Nature Management Supervision Service who are the chief state inspectors of the Russian Federation in the field of environmental protection in zone of the activities;
