Approve the enclosed Rules of provision from the federal budget of subsidies to the organizations of air transport for the purpose of ensuring availability of airborne transportations of passengers to Simferopol and in the opposite direction.

Rules of provision from the federal budget of subsidies to the organizations of air transport for the purpose of ensuring availability of airborne transportations of passengers to Simferopol and in the opposite direction

1. These rules establish the purposes, conditions and procedure for provision from the federal budget of subsidies to the organizations of air transport for the purpose of ensuring availability of airborne transportations of passengers to Simferopol and in the opposite direction (further - subsidies).

Subsidies are provided on compensation to the Russian organizations of air transport of the half-received income from implementation from May 15 to November 30 the current year inclusive of airborne transportations of passengers to Simferopol and in the opposite direction by aircrafts in salons of economy class regular flights along routes according to appendix (further - routes) on the specific tariff for the purpose of achievement of target indicators of the state program of the Russian Federation "Development of the transport system" approved by the order of the Government of the Russian Federation of April 15, 2014 No. 319 "About approval of the state program of the Russian Federation "Development of transport system".

2. In these rules the used concepts mean the following:

"specific tariff" - the rate for airborne transportation of passengers by the aircraft established by air carrier in salon of economy class along routes which size including tax on value added does not exceed the extreme size specified in appendix to these rules;

"passenger" - the citizen of the Russian Federation aged up to 23 years, the citizen of the Russian Federation - the woman at the age of over 55 years, the citizen of the Russian Federation - the man at the age of over 60 years, the citizen of the Russian Federation - the disabled person of the I group of any age and the accompanying his face, and also person accompanying the handicapped child and the disabled person since the childhood II or III groups.

3. The right to subsidy is granted to the air carriers which signed the agreement on provision of subsidy with Federal Air Transport Agency (further - the agreement) and performed airborne transportation of passengers on the specific tariff.

The agreement is signed according to the standard form established by the Ministry of Finance of the Russian Federation.

4. For the conclusion of the agreement the air carrier no later than March 30 of the current year submits in Federal Air Transport Agency the application for readiness to perform airborne transportation of passengers on the specific tariff, constituted in any form, with indication of routes, the frequency of accomplishment of regular flights and types of aircrafts which are planned to be used in case of airborne transportation of passengers (further - the statement), and also the reference signed by the CEO of air carrier confirming compliance of air carrier to the condition specified in item 4 (1) these rules.

For consideration of the applications the Federal Air Transport Agency creates the commission with participation of representatives of the Ministry of Transport of the Russian Federation (further - the commission). The structure of the commission and regulations on it affirm Federal Air Transport Agency.

After March 30 of the current year air carriers have the right to submit in Federal Air Transport Agency applications which are considered by the Commission in the case and procedure determined in Item 6 (1) these rules.

4(1). The commission takes cognizance of the statement of air carrier provided that on the first, preceding month in which the conclusion of the agreement, the air carrier applying for receipt of subsidy is planned conforms to the following requirements:

a) at air carrier are absent to the tax debt, charges and other obligatory payments in budgets of the budget system of the Russian Federation under which completion date came in accordance with the legislation of the Russian Federation;

b) the air carrier has no overdue debt on return to the relevant budget of the budget system of the Russian Federation of the subsidies, budget investments provided including according to other legal acts, and other arrears to the relevant budget of the budget system of the Russian Federation;

c) the air carrier is not in process of reorganization, liquidation, bankruptcy and has no restriction for implementation of economic activity;

d) the air carrier is not the Russian legal entity in whose authorized (share) capital share of participation of foreign legal entities whose place of registration is the state or the territory included in the list of the states and the territories which are providing preferential tax regime of the taxation and (or) not providing disclosure and provision of information approved by the Ministry of Finance of the Russian Federation when carrying out financial transactions (offshore zones) concerning such legal entities in total exceeds 50 percent;

e) the air carrier does not receive means from the relevant budget of the budget system of the Russian Federation according to other regulatory legal acts, municipal legal acts on the purpose, stipulated in Item 1 these rules.

5. The commission according to statements determines the planned amount of airborne transportations of passengers proceeding from the budgetary appropriations provided in the Federal Law on the federal budget for the corresponding financial year and planning period and limits of the budget obligations finished in accordance with the established procedure to Federal Air Transport Agency on the purposes specified in Item 1 of these rules, and the size of subsidy for one passenger on routes.

6. Contracts are signed by Federal Air Transport Agency within 14 days from the date of the termination of term of the direction by air carriers of statements (taking into account priority of filing of applications):

a) first of all - with the air carriers planning to use for implementation of airborne transportation of passengers on the specific tariff aircrafts of national production taking into account the frequency of accomplishment of regular flights along the routes specified in the statement;
